W skrócie — pięć rzeczy, które musisz wiedzieć
Ta ramka nie zastępuje Regulaminu, ale streszcza jego najważniejsze zasady.
- MoveBuddy to narzędzie, a nie usługa trenerska ani medyczna. Dostarczamy oprogramowanie. Nie tworzymy planów treningowych, nie prowadzimy treningów i nie udzielamy porad zdrowotnych.
- Trener jest niezależnym usługodawcą. Nie jesteśmy stroną umowy między Trenerem a jego Klientem. Nie weryfikujemy kwalifikacji Trenerów. Za treść planu i jakość opieki odpowiada Trener.
- Przechowujemy Twoje dane i pliki na naszych serwerach. Zdjęcia postępów, wideo, wiadomości głosowe, pomiary ciała, odpowiedzi w ankietach (w tym o zdrowiu) i historię treningów. Nie są przechowywane „tylko na Twoim telefonie". Szczegóły: § 8.
- Subskrypcję kupujesz od Apple albo od Google, nie od nas. Płatność, paragon, anulowanie i zwrot obsługuje sklep zakupu: App Store albo Google Play. My włączamy uprawnienia po potwierdzeniu zakupu przez Apple lub Google. Szczegóły: § 11–§ 13.
- Brak subskrypcji nigdy nie blokuje Twoich danych. Konto przechodzi na Plan Darmowy z limitami. Nic nie jest kasowane ani zamykane. Szczegóły: § 10.
Dwa reżimy. Część postanowień Regulaminu stosuje się wyłącznie do Użytkowników będących przedsiębiorcami — gdy korzystanie z Aplikacji pozostaje w bezpośrednim związku z ich działalnością gospodarczą lub zawodową i ma dla nich charakter zawodowy. Postanowienia te są wyraźnie oznaczone i nie dotyczą konsumentów ani osób fizycznych, o których mowa w art. 3855 Kodeksu cywilnego (przedsiębiorca na prawach konsumenta). Wobec konsumenta stosuje się wyłącznie przepisy ustawowe; żadne postanowienie Regulaminu ich nie wyłącza ani nie ogranicza.
§ 1. Definicje
- Usługodawca, my — Movebuddy Software Spółka z Ograniczoną Odpowiedzialnością z siedzibą we Wrocławiu, ul. Marsz. Józefa Piłsudskiego 74 lok. 320, 50-020 Wrocław, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy dla Wrocławia-Fabrycznej we Wrocławiu, VI Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0001258724, NIP 8971976759, REGON 545419926.
- Aplikacja, MoveBuddy — aplikacja MoveBuddy: mobilna oraz udostępniana przez przeglądarkę, wraz z częścią serwerową i powiązanymi usługami sieciowymi.
- Usługa — udostępnienie Aplikacji do korzystania na warunkach Regulaminu.
- Użytkownik — osoba, która utworzyła Konto w Aplikacji.
- Przedsiębiorca — Użytkownik, dla którego korzystanie z Aplikacji pozostaje w bezpośrednim związku z prowadzoną działalnością gospodarczą lub zawodową i ma dla niego charakter zawodowy. Postanowienia oznaczone jako dotyczące Przedsiębiorców nie stosują się do konsumentów ani do osób, o których mowa w art. 3855 k.c.
- Konto — indywidualny, zabezpieczony hasłem zbiór danych i uprawnień Użytkownika.
- Trener — Użytkownik z rolą trenera personalnego, który prowadzi w Aplikacji własnych Klientów i który jest stroną umowy o Subskrypcję.
- Klient — Użytkownik z rolą klienta. Klient może być Klientem Trenera (pozostaje w otwartej Współpracy z Trenerem) albo Użytkownikiem Samodzielnym (nie ma przypisanego Trenera i korzysta z Aplikacji dla siebie).
- Współpraca — relacja między Trenerem a Klientem zapisana w Aplikacji, otwarta w chwili przyjęcia Zaproszenia i zamknięta w chwili jej zakończenia przez którąkolwiek ze stron.
- Zaproszenie — czasowo ograniczona propozycja rozpoczęcia Współpracy. Zaproszenie może wyjść od Trenera (Oferta) albo od Klienta, który poda kod Trenera (Zgłoszenie).
- Wpis na Liście — pozycja Klienta na liście Klientów Trenera, istniejąca od chwili dodania przez Trenera, także przed przyjęciem Oferty.
- Treści Użytkownika — wszystko, co Użytkownik wprowadza lub wysyła do Aplikacji: teksty, wiadomości, zdjęcia, pliki wideo, nagrania głosowe, pomiary, odpowiedzi w ankietach, plany, ćwiczenia i notatki.
- Ankieta Wstępna — kwestionariusz, o którego wypełnienie Aplikacja prosi Klienta przed rozpoczęciem korzystania z części treningowej Aplikacji.
- Check-in — powtarzalna ankieta kontrolna (dzienna, tygodniowa albo miesięczna), w której Klient raportuje m.in. masę ciała, jakość snu, poziom energii, obwody ciała i opcjonalnie Zdjęcia Postępów.
- Zdjęcia Postępów — zdjęcia sylwetki wykonywane przez Klienta w ramach Check-inu, w maksymalnie trzech ujęciach (przód, bok, tył).
- Subskrypcja — płatny, odnawialny dostęp do rozszerzonych limitów Aplikacji.
- Plan Darmowy — bezpłatny poziom Usługi z limitami, na którym działa każde Konto bez aktywnej Subskrypcji.
- App Store — sklep aplikacji prowadzony przez Apple Inc. i podmioty z jej grupy.
- Google Play — sklep aplikacji prowadzony przez Google LLC i podmioty z jej grupy. Sprzedawcą Subskrypcji kupowanych w Google Play przez użytkowników z Europejskiego Obszaru Gospodarczego jest Google Commerce Limited (Gordon House, Barrow Street, Dublin 4, Irlandia).
- Regulamin — ten dokument.
§ 2. Kto świadczy Usługę
- Usługę świadczy Usługodawca:

- Adres do kontaktu w każdej sprawie dotyczącej Usługi, w tym reklamacji: contact@movebuddy.pl. Adres do korespondencji pisemnej jest tożsamy z adresem siedziby wskazanym w ust. 1.
- Regulamin jest udostępniany nieodpłatnie w Aplikacji oraz pod adresem https://movebuddy.pl/regulamin, w sposób umożliwiający jego pozyskanie, odtworzenie i utrwalenie.
- Regulamin stanowi regulamin świadczenia usług drogą elektroniczną w rozumieniu ustawy o świadczeniu usług drogą elektroniczną.
§ 3. Czym MoveBuddy jest, a czym nie jest
Ten paragraf wyznacza granice Usługi. Jest podstawą całego Regulaminu i ma pierwszeństwo przy wykładni pozostałych postanowień.
- MoveBuddy jest narzędziem. Dostarczamy oprogramowanie, które pozwala planować treningi, zapisywać ich wykonanie, prowadzić pomiary, wymieniać wiadomości i przechowywać powiązane pliki. Nasze świadczenie polega na udostępnieniu tego oprogramowania i utrzymaniu go w działaniu.
- Nie świadczymy usług trenerskich. Nie tworzymy planów treningowych, nie dobieramy ćwiczeń, obciążeń ani progresji, nie prowadzimy treningów i nie nadzorujemy ich wykonania. Plany i ćwiczenia w Aplikacji tworzy Trener albo sam Użytkownik.
- Nie świadczymy usług medycznych, fizjoterapeutycznych ani dietetycznych. Nie udzielamy porad zdrowotnych, nie stawiamy diagnoz, nie oceniamy przeciwwskazań do wysiłku i nie interpretujemy danych zdrowotnych wprowadzonych do Aplikacji.
- Aplikacja nie jest wyrobem medycznym w rozumieniu Rozporządzenia (UE) 2017/745 i nie jest przeznaczona do diagnozowania, zapobiegania, monitorowania, przewidywania, rokowania, leczenia ani łagodzenia choroby. Nie zastępuje konsultacji z lekarzem, fizjoterapeutą ani dietetykiem.
- Aplikacja nie prowadzi kwalifikacji do wysiłku. Nie przeprowadzamy badania przesiewowego ani ankiety kwalifikacyjnej typu PAR-Q i nie odbieramy oświadczeń o braku przeciwwskazań. Pytania o zdrowie w Ankiecie Wstępnej służą wyłącznie temu, aby Trener miał informacje, które Klient sam zdecydował się mu przekazać. Nie oceniamy tych odpowiedzi i nie wyciągamy z nich żadnych wniosków.
- Nie gwarantujemy rezultatu treningowego. Nie obiecujemy przyrostu siły, utraty masy ciała, zmiany sylwetki, poprawy wydolności ani żadnego innego efektu. Efekt zależy od czynników pozostających poza Usługą.
- Obliczenia w Aplikacji są pomocnicze. Wyliczenia progresji, rekordów życiowych, tonażu, zgodności z planem, procentu maksimum i podobne wielkości są narzędziem pomocniczym opartym na danych, które Użytkownik sam wprowadził. Nie są rekomendacją treningową ani zaleceniem zdrowotnym, a ich prawidłowość zależy od prawidłowości danych wejściowych.
- Nie jesteśmy klubem fitness ani organizacją zrzeszającą trenerów. Aplikacja jest przeznaczona dla samodzielnych trenerów personalnych i ich klientów. Nie kierujemy Usługi do klubów fitness ani do organizacji zatrudniających wielu trenerów.
- Aplikacja nie ma funkcji społecznościowych. Nie ma udostępniania treści innym Użytkownikom poza własnym Trenerem, nie ma rankingów ani porównań między Klientami.
- Użytkownik decyduje samodzielnie o podjęciu wysiłku fizycznego i korzysta z części treningowej Aplikacji na własną odpowiedzialność. Użytkownik zobowiązuje się nie podejmować aktywności, co do której lekarz stwierdził przeciwwskazania, przerwać ją w razie wystąpienia bólu, zawrotów głowy, duszności lub innych niepokojących objawów oraz zasięgnąć porady lekarza. Zalecamy konsultację lekarską przed rozpoczęciem lub istotną zmianą aktywności fizycznej, zwłaszcza przy chorobach, urazach, ciąży i przyjmowanych lekach.
- Informacje o stanie zdrowia Użytkownik podaje w Aplikacji dobrowolnie i z własnej inicjatywy, w celu przekazania ich Trenerowi. Nie zbieramy ich w celu oceny zdolności do wysiłku, nie oceniamy ich, nie interpretujemy i nie opieramy na nich działania żadnej funkcji Aplikacji.
- Jeżeli szkoda powstała albo uległa zwiększeniu wskutek podania nieprawdziwych lub niepełnych informacji, niezastosowania się do ust. 10, do zaleceń lekarza albo do wskazań Trenera, okoliczność ta podlega uwzględnieniu przy ustalaniu zakresu odpowiedzialności i wysokości odszkodowania (art. 362 k.c.).
§ 4. Wymagania techniczne
- Do korzystania z Aplikacji potrzebne są: urządzenie mobilne z systemem iOS albo Android w wersji wskazanej jako minimalna odpowiednio w App Store albo Google Play, dostęp do internetu, aktywny adres e-mail oraz zainstalowana aktualna wersja Aplikacji.
- Aplikacja wymaga połączenia z internetem. Większość funkcji nie działa offline, a dane wprowadzone bez połączenia mogą zostać zsynchronizowane z opóźnieniem albo, w razie konfliktu, nie zostać zapisane.
- Wybrane funkcje wymagają zgody na dostęp do zasobów urządzenia: kamery i galerii (zdjęcia profilowe, Zdjęcia Postępów, zdjęcia i wideo w czacie), mikrofonu (wiadomości głosowe), powiadomień (powiadomienia push). Odmowa zgody wyłącza daną funkcję, ale nie blokuje pozostałej części Aplikacji.
- Koszty transmisji danych i koszty urządzenia ponosi Użytkownik według cennika swojego operatora.
- Zalecamy korzystanie z aktualnej wersji Aplikacji i systemu operacyjnego. Nie zapewniamy działania wersji Aplikacji, która nie jest już wspierana, ani działania na urządzeniach z naruszoną ochroną systemu (jailbreak).
- Aktualizacje Aplikacji są dystrybuowane wyłącznie przez App Store i Google Play.
§ 5. Konto, rejestracja i wiek minimalny
- Korzystanie z Aplikacji wymaga Konta. Konto jest imienne i przypisane do jednej osoby.
- Konto zakłada się przez rejestrację adresem e-mail i hasłem albo przez zalogowanie się kontem Apple lub kontem Google. Podczas uzupełniania profilu Użytkownik wybiera rolę: Trenera albo Klienta. Rola administracyjna nie jest dostępna do samodzielnego wyboru.
- Do utworzenia Konta wymagamy: adresu e-mail, imienia, nazwiska, płci i daty urodzenia. Trener podaje dodatkowo numer telefonu.
- Wiek minimalny to 16 lat. Wiek jest weryfikowany na serwerze na podstawie podanej daty urodzenia — rejestracja osoby młodszej niż 16 lat jest odrzucana. Podanie nieprawdziwej daty urodzenia jest naruszeniem Regulaminu i stanowi podstawę do zablokowania Konta.
- Umowa o świadczenie Usługi jest zawierana na czas nieoznaczony w chwili utworzenia Konta. Utworzenie Konta jest bezpłatne. Warunkiem utworzenia Konta jest udostępnienie Użytkownikowi Regulaminu i Polityki Prywatności przed zawarciem umowy — w sposób umożliwiający ich pozyskanie, odtworzenie i utrwalenie — oraz złożenie oświadczenia o ich akceptacji.
- Utrwalamy fakt akceptacji: datę i godzinę złożenia oświadczenia, oznaczenie wersji zaakceptowanych dokumentów, identyfikator Konta oraz techniczne dane zdarzenia. Zapis ten przechowujemy przez czas trwania umowy i przez okres przedawnienia roszczeń z niej wynikających.
- Użytkownikowi, który zaakceptował Regulamin, doręczamy każdą jego zmianę w trybie § 21. Regulaminem wiążącym dla stron jest wersja obowiązująca w dniu dokonania danej czynności, a w zakresie skutków trwałych — wersja obowiązująca w dniu ich powstania.
- Osoba rejestrująca się samodzielnie potwierdza swój adres e-mail. Do chwili potwierdzenia Konto ma ograniczoną funkcjonalność.
- Użytkownik podaje dane prawdziwe i aktualne. Użytkownik nie może udostępniać Konta ani danych logowania innej osobie ani zakładać Konta dla innej osoby bez jej wiedzy — z wyjątkiem Zaproszenia opisanego w § 7. Użytkownik ponosi odpowiedzialność za czynności dokonane z użyciem jego danych logowania, chyba że nastąpiły one wskutek okoliczności, za które odpowiadamy.
- Użytkownik chroni swoje hasło. Prosimy o niezwłoczne zawiadomienie nas na contact@movebuddy.pl, jeżeli Użytkownik podejrzewa, że ktoś uzyskał dostęp do jego Konta.
§ 6. Role Użytkowników
- W Aplikacji istnieją trzy role: Trener, Klient oraz rola administracyjna zastrzeżona dla Usługodawcy (§ 8.4 pkt 6).
- Trener prowadzi listę swoich Klientów, tworzy plany treningowe i ćwiczenia, przypisuje ankiety, prowadzi kalendarz i czat oraz przegląda dane treningowe i pomiarowe swoich Klientów. Trener jest stroną umowy o Subskrypcję.
- Klient Trenera korzysta z Aplikacji w ramach usługi świadczonej przez swojego Trenera. Klient Trenera nie płaci nam za korzystanie z Aplikacji.
- Użytkownik Samodzielny korzysta z Aplikacji dla siebie, bez Trenera — planuje i wykonuje własne treningi, prowadzi pomiary i przypisuje sobie ankiety.
- Trener trenuje w Aplikacji także siebie. Wraz z utworzeniem profilu Trenera powstaje na tym samym Koncie profil Klienta, w którym Trener prowadzi własne treningi. Nie jest to drugie Konto ani drugi login. Ten wewnętrzny profil jest trwały i nie można go usunąć ani odłączyć — ma to bezpośredni skutek dla usunięcia Konta Trenera, opisany w § 20 ust. 3. Profil ten zajmuje jedno miejsce w limicie Klientów.
§ 7. Relacja Trener–Klient i jak powstaje
- Współpraca powstaje wyłącznie za zgodą obu stron. Trener wysyła Ofertę Klientowi albo Klient wysyła Zgłoszenie Trenerowi, podając jego kod. Współpraca zaczyna się w chwili przyjęcia Zaproszenia.
- Trener może dodać osobę do swojej listy, podając jej imię, nazwisko i adres e-mail — przed jakimkolwiek działaniem tej osoby. Powstaje wtedy Wpis na Liście oraz techniczna tożsamość bez hasła. Od tej chwili Trener może przygotowywać dla tej osoby plan, przypisywać ankiety, planować sesje, zapisywać notatki i rejestrować pomiary. Osoba zaproszona nie ma w tym czasie dostępu do części klienckiej Aplikacji — nie widzi planu, harmonogramu, czatu ani profilu Trenera. Trener może w tym czasie napisać wiadomości, które osoba zaproszona zobaczy dopiero po przyjęciu Zaproszenia.
- Zaproszony ma prawo odmówić. Po potwierdzeniu adresu e-mail pokazujemy, kto go dodał, i pytamy o zgodę. Odmowa jest równie łatwo dostępna jak przyjęcie. Potwierdzenie adresu e-mail samo w sobie nie jest przyjęciem Współpracy.
- Dwa różne terminy: link i kod z Zaproszenia są ważne 24 godziny (można je wysłać ponownie), a sama Oferta stoi 14 dni.
- Oferta nieprzyjęta w ciągu 14 dni albo wycofana przez Trenera znika w całości. Usuwamy wtedy techniczną tożsamość, Wpis na Liście oraz wszystko, co Trener do niego dołączył — plan, ankiety, harmonogram, notatki i pomiary.
- Po przyjęciu Zaproszenia tożsamość należy do Klienta. Od tej chwili żadne działanie Trenera ani żaden termin nie usuwa Konta Klienta. Zakończenie Współpracy archiwizuje Klienta u Trenera, ale nie usuwa człowieka.
- Jeżeli Oferta trafi na adres e-mail, który ma już Konto, nie tworzymy nowej tożsamości i nie prosimy o potwierdzenie adresu. Zgodę wyraża wtedy zalogowany Użytkownik.
- Nie jesteśmy stroną umowy między Trenerem a Klientem. Umowa o świadczenie usług trenerskich jest zawierana bezpośrednio między Trenerem a Klientem, poza Aplikacją. Nie odpowiadamy za jej zawarcie, wykonanie, rozliczenie ani rozwiązanie.
- Nie weryfikujemy kwalifikacji Trenerów. Nie sprawdzamy wykształcenia, certyfikatów, uprawnień, doświadczenia, ubezpieczenia ani niekaralności Trenerów. Obecność Trenera w Aplikacji nie jest naszą rekomendacją ani poświadczeniem jego kompetencji. Klient wybiera Trenera na własną odpowiedzialność.
- Za treść planu treningowego odpowiada jego autor — Trener, który go utworzył, albo Użytkownik Samodzielny, który utworzył plan dla siebie. Nie zatwierdzamy planów, nie oceniamy ich bezpieczeństwa i nie ingerujemy w ich treść.
- Płatności między Klientem a Trenerem nie przechodzą przez Aplikację. Aplikacja nie pośredniczy w zapłacie za usługi trenerskie, nie przyjmuje takich płatności, nie rozlicza ich i nie wystawia za nie dokumentów.
- Każda strona może w każdej chwili zakończyć Współpracę — zarówno Trener, jak i Klient. Klient nie potrzebuje do tego zgody Trenera. Skutki opisuje § 9.
- Trener odpowiada za podstawę prawną przetwarzania danych osoby, którą dodaje. Dodając osobę do listy Klientów albo wysyłając Zaproszenie, Trener oświadcza, że dysponuje podstawą prawną przetwarzania jej danych osobowych oraz że osoba ta wyraziła zainteresowanie współpracą albo w inny sposób uprawniła Trenera do podania jej adresu e-mail w tym celu.
- Obowiązek informacyjny wobec osoby zaproszonej wykonuje Trener w zakresie własnego przetwarzania (art. 14 RODO). My wykonujemy go w zakresie własnego przetwarzania — w treści Zaproszenia i w Polityce Prywatności.
- Trener nie umieszcza w pytaniach własnych ankiety ani w innych polach Aplikacji pytań o dane, o których mowa w art. 9 ust. 1 RODO (w szczególności o zdrowie, seksualność, przekonania, pochodzenie), chyba że dysponuje własną, ważną podstawą z art. 9 ust. 2 RODO. Trener nie czyni obowiązkowym żadnego pytania dotyczącego zdrowia. Możemy usunąć pytanie naruszające ten ustęp albo ograniczyć funkcję pytań własnych, informując o tym Trenera.
- Zwolnienie z odpowiedzialności — dotyczy wyłącznie Trenerów będących Przedsiębiorcami. Trener zwolni nas z odpowiedzialności oraz naprawi szkodę — obejmującą zasądzone lub ugodzone kwoty, administracyjne kary pieniężne oraz uzasadnione koszty obsługi prawnej — jeżeli poniesiemy ją w związku z naruszeniem przez Trenera ust. 13–15, z treścią planu treningowego lub jakością jego usług, albo z roszczeniem jego Klienta lub osoby przez niego zaproszonej. Zawiadomimy Trenera o roszczeniu niezwłocznie i umożliwimy mu udział w obronie.
§ 7a. Role w ochronie danych osobowych
- W odniesieniu do danych osobowych Klienta Usługodawca i Trener są odrębnymi, niezależnymi administratorami. Nie są współadministratorami w rozumieniu art. 26 RODO, a Usługodawca nie jest podmiotem przetwarzającym dane na zlecenie Trenera w rozumieniu art. 28 RODO.
- Usługodawca jest administratorem w zakresie: prowadzenia Konta Klienta i świadczenia mu Usługi, udostępniania danych Trenerowi w czasie otwartej Współpracy, bezpieczeństwa Aplikacji, obsługi Subskrypcji i reklamacji, wykonania obowiązków prawnych oraz utrzymania i rozwoju Aplikacji. Zasady tego przetwarzania opisuje Polityka Prywatności.
- Trener jest administratorem w zakresie własnej usługi trenerskiej — w szczególności decyduje, o co pyta w pytaniach własnych ankiety, jakie dane o Kliencie wprowadza, jakie prowadzi notatki i w jaki sposób wykorzystuje wyniki. W tym zakresie Trener samodzielnie wykonuje obowiązki administratora, w tym obowiązki informacyjne z art. 13 i 14 RODO oraz obsługę żądań osób, których dane dotyczą.
- Żądanie Klienta dotyczące danych, o których decyduje Trener, przekazujemy Trenerowi i informujemy o tym Klienta. Nie odpowiadamy za sposób wykonania przez Trenera jego obowiązków.
- Udostępnienie Trenerowi danych Klienta w czasie otwartej Współpracy następuje na podstawie art. 6 ust. 1 lit. b RODO, a w zakresie danych o zdrowiu — na podstawie odrębnej, wyraźnej zgody Klienta (art. 9 ust. 2 lit. a RODO).
- Jeżeli organ nadzorczy albo sąd stwierdzi, że w określonym zakresie Usługodawca i Trener są współadministratorami, w tym zakresie stosuje się Załącznik nr 1.
§ 8. Dane i pliki, które przechowujemy — powiedziane wprost
Zasady przetwarzania danych osobowych, podstawy prawne i uprawnienia Użytkownika opisuje odrębna Polityka Prywatności; ten paragraf mówi wprost, co i gdzie trzymamy.
8.1. To, co wysyłasz do Aplikacji, trafia na nasze serwery
Twoje dane i pliki nie są przechowywane wyłącznie na Twoim telefonie. Wysyłamy je na nasze serwery i tam je przechowujemy, bo bez tego Usługa nie może działać: Twój Trener musi zobaczyć Twoje dane, Twoja historia musi być dostępna po zmianie telefonu, a czat musi działać po obu stronach.

Nie zapisujemy Twojego hasła w postaci jawnej — jest przechowywane w postaci nieodwracalnego skrótu przez dostawcę uwierzytelniania (ust. 8.5).
Aplikacja prosi o wypełnienie Ankiety Wstępnej przed rozpoczęciem korzystania z części treningowej. Check-iny nigdy nie blokują dostępu. Wypełnioną ankietę zamykamy — jej treści nie da się już zmienić, a pytania są zamrażane w chwili wysłania.
8.1a. Dane o zdrowiu
Pytania o przebyte urazy, choroby i stany zdrowia oraz o przyjmowane leki dotyczą danych szczególnej kategorii w rozumieniu art. 9 RODO. Zadajemy je wyłącznie po uzyskaniu odrębnej, wyraźnej zgody, o którą prosimy przed sekcją zdrowotną Ankiety Wstępnej. Odpowiedź na te pytania jest dobrowolna, a odmowa nie ogranicza dostępu do Aplikacji ani do żadnej jej funkcji. Zgodę można wycofać w każdej chwili w ustawieniach Konta; wycofanie powoduje usunięcie tych odpowiedzi i utratę do nich dostępu przez Trenera. Trener nie może uczynić pytania o zdrowie obowiązkowym (§ 7 ust. 15).
8.2. Zdjęcia, wideo i nagrania głosowe nie są przetwarzane „lokalnie"
- Zdjęcia Postępów są zmniejszane i kompresowane na urządzeniu, a następnie wysyłane na nasze serwery i tam przechowywane. Widzi je Twój Trener. Przed pierwszym wysłaniem pokazujemy odrębną informację o tym, dokąd trafia zdjęcie i kto je zobaczy, i prosimy o potwierdzenie.
- Zdjęcia i pliki wideo wysłane w czacie są przechowywane na naszych serwerach i widzi je druga strona rozmowy.
- Wiadomości głosowe są nagrywane na urządzeniu, a następnie wysyłane na nasze serwery i tam przechowywane. Odsłuchuje je druga strona rozmowy.
- Ze zdjęć usuwamy metadane, w tym współrzędne GPS — najpierw na urządzeniu, a następnie ponownie na serwerze, przed zapisaniem.
- Możesz usunąć każde swoje Zdjęcie Postępów w dowolnym momencie. Usunięcie działa również wobec Trenera.
8.3. Gdzie fizycznie leżą dane i pliki
- Pliki (zdjęcia, wideo, nagrania głosowe) przechowujemy w chmurowym magazynie obiektowym. Prywatny magazyn plików — w którym trzymamy Zdjęcia Postępów oraz media z czatu — jest przypisany do infrastruktury na terenie Europejskiego Obszaru Gospodarczego.
- Pliki prywatne nie mają publicznych adresów. Są udostępniane wyłącznie przez krótko żyjące, podpisane linki generowane po sprawdzeniu uprawnień.
- Nie prowadzimy drugiej kopii plików prywatnych. Pliki żyją wyłącznie w jednym magazynie — nie kopiujemy ich ani do innego dostawcy, ani do własnej infrastruktury. Utrata danych po stronie dostawcy magazynu oznaczałaby utratę plików. Dlatego zalecamy zachowanie własnych kopii zdjęć, które są dla Ciebie ważne (§ 17 ust. 7).
- Zdjęcia profilowe (awatary), materiały biblioteki ćwiczeń oraz nagrania demonstracyjne ćwiczeń wgrane przez Trenera przechowujemy w magazynie publicznym, pod nieodgadywalnymi adresami. Nie są indeksowane ani powiązane z listą Użytkowników, ale nie są chronione podpisanym linkiem. Dotyczy to również nagrania demonstracyjnego, które może zawierać wizerunek Trenera. Zdjęcia Postępów nigdy nie trafiają do magazynu publicznego.
- Bazę danych (Konto, pomiary, cele, historia treningów, treść wiadomości, ankiety, dane subskrypcyjne) prowadzi dla nas dostawca infrastruktury chmurowej i bazy danych, w regionie na terenie Europejskiego Obszaru Gospodarczego.
- Serwer aplikacji (część obliczeniowa, bez trwałych danych Użytkowników) działa na serwerze dedykowanym na terenie Europejskiego Obszaru Gospodarczego.
8.4. Kto widzi Twoje dane
- Twój Trener widzi dane swojego Klienta: profil, odpowiedzi w Ankiecie Wstępnej (także te dotyczące zdrowia), odpowiedzi w Check-inach, pomiary ciała i ich historię, Zdjęcia Postępów, cele, pełną historię treningów, kalendarz, statystyki oraz całą rozmowę na czacie.
- Notatka Trenera o Kliencie jest widoczna tylko dla tego Trenera. Klient jej nie widzi w Aplikacji. Nie zmienia to prawa Klienta do uzyskania jej treści na podstawie przepisów o ochronie danych osobowych — takie żądanie prosimy kierować na contact@movebuddy.pl.
- Komentarze Trenera do treningu są widoczne dla Klienta i tylko do odczytu.
- Inni Klienci nie widzą Twoich danych. Trener, który Cię nie prowadzi, nie dowie się nawet o istnieniu Twojej sesji treningowej.
- Nie sprzedajemy Twoich danych i nie udostępniamy ich w celach marketingowych podmiotom trzecim.
- Rola administracyjna Usługodawcy ma dostęp techniczny do danych Kont, w tym do ankiet, pomiarów i celów, w zakresie niezbędnym do utrzymania Usługi i obsługi zgłoszeń. Dostęp administracyjny nie obejmuje notatek Trenera o Kliencie.
- Dostęp mają wyłącznie: Ty, Twój Trener (gdy Współpraca jest otwarta), nasi upoważnieni pracownicy i współpracownicy w niezbędnym zakresie oraz nasi podwykonawcy techniczni z ust. 8.5.
8.5. Komu powierzamy dane (podwykonawcy techniczni)
Korzystamy z podwykonawców technicznych. Poniżej wskazujemy kategorie odbiorców, do czego z nich korzystamy i jakie dane do nich trafiają.

Tożsamość konkretnych podmiotów przetwarzających udostępniamy na żądanie osoby, której dane dotyczą — wystarczy napisać na contact@movebuddy.pl.
Dane przetwarzamy na terenie Europejskiego Obszaru Gospodarczego. Część przekazań do państw trzecich odbywa się na podstawie standardowych klauzul umownych zatwierdzonych przez Komisję Europejską; szczegóły opisuje Polityka Prywatności.
Do logów technicznych nie zapisujemy treści danych. Nie logujemy adresów e-mail, numerów telefonu, imion, dat urodzenia, treści wiadomości ani notatek, ani wartości zdrowotnych — celów, pomiarów i wyników treningów.
Możemy powierzać przetwarzanie danych kolejnym podwykonawcom technicznym oraz zmieniać dotychczasowych. Nie wymaga to zgody Użytkownika ani zmiany Regulaminu. Nowego podwykonawcę dopuszczamy dopiero po zawarciu umowy powierzenia spełniającej wymagania art. 28 RODO.
8.6. Jak długo przechowujemy
Dane przechowujemy przez czas istnienia Konta, nie dłużej jednak niż przez 24 miesiące od ostatniej aktywności na Koncie (§ 20 ust. 4a). Po usunięciu Konta przechowujemy wyłącznie dane wskazane w § 20 ust. 8, przez wskazane tam okresy i wyłącznie we wskazanych tam celach.

- Wstrzymanie albo usunięcie Check-inu zachowuje zebrane odpowiedzi. Ankiety Wstępnej nie da się usunąć.
- Po zakończeniu Współpracy dane Klienta pozostają na jego Koncie. Zmienia się tylko dostęp Trenera (§ 9).
8.7. Analityka i diagnostyka
- Zbieramy dane o awariach Aplikacji, aby móc je naprawić. Raport zawiera informacje techniczne i pseudonimowy identyfikator Konta, bez treści Twoich danych.
- Zbieramy dane telemetryczne o działaniu Aplikacji i serwera (czasy odpowiedzi, błędy, ekran, na którym wystąpił problem).
- Wersja Aplikacji dystrybuowana w App Store i Google Play nie rejestruje sposobu korzystania z ekranów — nie prowadzimy w niej nagrywania sesji ani map aktywności. Narzędzie tego rodzaju może zostać uruchomione wyłącznie w wewnętrznych wersjach testowych i wyłącznie po uzyskaniu wyraźnej zgody osoby korzystającej z takiej wersji; zgodę można w każdej chwili wycofać.
- Nie korzystamy z Treści Użytkownika do trenowania modeli uczenia maszynowego udostępnianych podmiotom trzecim. Nie wyklucza to wykorzystania danych zanonimizowanych i zestawień zbiorczych (ust. 6) do rozwoju własnych rozwiązań.
- Możemy analizować sposób korzystania z Aplikacji — użycie funkcji, liczniki zdarzeń, czasy odpowiedzi, wskaźniki błędów — w celu utrzymania, pomiaru i rozwoju Usługi oraz planowania nowych funkcji. Do celów tych nie wykorzystujemy treści danych o zdrowiu, Zdjęć Postępów, nagrań głosowych ani treści wiadomości. Podstawą jest nasz prawnie uzasadniony interes (art. 6 ust. 1 lit. f RODO); Użytkownik może wnieść sprzeciw na zasadach opisanych w Polityce Prywatności.
- Na podstawie danych z ust. 5 tworzymy zestawienia zbiorcze i zbiory zanonimizowane, z których nie da się zidentyfikować żadnej osoby. Zestawienia takie stanowią nasz zasób; możemy z nich korzystać bez ograniczenia czasowego, także po usunięciu Konta, w tym publikować je w postaci statystyk zbiorczych.
8.8. Powiadomienia i komunikacja
- Wysyłamy powiadomienia dotyczące zdarzeń w Aplikacji oraz wiadomości niezbędne do wykonania umowy, zapewnienia bezpieczeństwa i poinformowania o zmianach Regulaminu lub istotnych zmianach Usługi. Powiadomienia i wiadomości o charakterze marketingowym wysyłamy wyłącznie za zgodą Użytkownika, wyrażoną odrębnie i możliwą do wycofania w każdej chwili w ustawieniach Konta; brak zgody nie wpływa na dostęp do Usługi ani na zakres funkcji.
- Klient może otrzymać powiadomienie o: wiadomości od Trenera, ocenie treningu przez Trenera, treningu zaplanowanym na dziś, Check-inie do wypełnienia oraz — jako przypomnienie z urządzenia — o niedokończonym treningu. Trener może otrzymać powiadomienie o wiadomości od Klienta i o przesłanym Check-inie.
- Każdy rodzaj powiadomienia można wyłączyć osobno, a ustawienie jest zapisane przy Koncie, nie na urządzeniu.
- W treści powiadomienia nigdy nie umieszczamy odpowiedzi z ankiet, pomiarów ani danych zdrowotnych. Powiadomienie o wiadomości z czatu zawiera imię nadawcy i fragment wiadomości.
- Aplikacja nie ma historii powiadomień. Nie wysyłamy powiadomień informujących o pominiętym treningu, zaległości ani spadku formy.
§ 9. Zakończenie Współpracy
- Współpracę może zakończyć każda ze stron, w każdej chwili: Trener (u niego nazywa się to archiwizacją Klienta) albo Klient (u niego — zakończeniem współpracy z Trenerem). Klient nie potrzebuje zgody Trenera.
- Zakończenie Współpracy nie usuwa Konta ani danych.
- Po zakończeniu Współpracy Trener: zachowuje wpis w archiwum (kogo prowadził i w jakim okresie), przeszłe sesje w swoim kalendarzu, własne notatki oraz zapis własnej pracy, swoje szablony planów i ćwiczeń, a także historię czatu w trybie tylko do odczytu. Traci: możliwość pisania na czacie, dostęp do bieżących danych Klienta, tworzenie i przypisywanie planów oraz ankiet, planowanie nowych sesji.
- Po zakończeniu Współpracy Klient: zachowuje pełny dostęp do Aplikacji jako Użytkownik Samodzielny, całą swoją historię, rekordy, pomiary i statystyki; może dokończyć rozpoczęty plan; może odczytać plany, które kiedykolwiek zostały mu przypisane; zachowuje historię czatu w trybie tylko do odczytu. Ćwiczenia utworzone przez byłego Trenera pozostają widoczne w planach i historii Klienta, ale przestają być dostępne w wyszukiwaniu biblioteki.
- Zaplanowane sesje cykliczne i Check-iny zostają zatrzymane; przyszłe terminy są zwalniane.
- Powrót do Współpracy z tym samym Trenerem wymaga nowego Zaproszenia i zgody, po upływie 48 godzin od zakończenia i pod warunkiem dostępnego miejsca w limicie Trenera.
- Zakończenie Współpracy przez Trenera nie jest osobno zawiadamiane. Klient rozpoznaje je po zmianie zakresu funkcji Aplikacji; jego dane i dostęp do Aplikacji pozostają nienaruszone (ust. 4).
- Wewnętrznego profilu Klienta Trenera (§ 6 ust. 5) nie można zakończyć z żadnej strony.
§ 10. Plan Darmowy i limity
- Każde Konto bez aktywnej Subskrypcji działa na Planie Darmowym. Plan Darmowy jest bezpłatny i nie jest ograniczony czasowo.
- Plan Darmowy ma limity — w szczególności limit liczby aktywnych Klientów Trenera. Liczba Klientów w archiwum nie jest limitowana. Aktualne limity są prezentowane w Aplikacji. Wewnętrzny profil Klienta Trenera (§ 6 ust. 5) zajmuje jedno miejsce w limicie, a limit każdego płatnego planu jest o to jedno miejsce podniesiony.
- Możemy zmienić limity Planu Darmowego oraz planów płatnych z ważnych przyczyn, którymi są: istotna zmiana kosztów świadczenia Usługi, zmiana warunków dostawców, od których Usługa zależy, konieczność zapewnienia bezpieczeństwa albo stabilności Usługi, zmiana przepisów prawa albo istotna zmiana zakresu funkcji Aplikacji. O zmianie limitów na niekorzyść Użytkownika informujemy co najmniej 30 dni wcześniej w Aplikacji oraz e-mailem. Zmiana taka nie powoduje utraty dostępu do danych ani odłączenia dotychczasowych Klientów; może ograniczyć wyłącznie możliwość dodawania nowych. Użytkownik, który nie zgadza się na zmianę, może rozwiązać umowę w trybie § 21 ust. 3. Zmiany na korzyść Użytkownika wprowadzamy bez uprzedzenia. Zmiana limitów nie wpływa na warunki opłaconego już okresu rozliczeniowego.
- Wpis na Liście zajmuje miejsce w limicie od chwili jego utworzenia — także przed przyjęciem Oferty przez zaproszoną osobę.
- Brak Subskrypcji nigdy nie oznacza utraty dostępu do danych. Nie kasujemy, nie ukrywamy i nie zamykamy danych z powodu braku Subskrypcji.
- Jeżeli po zakończeniu Subskrypcji liczba aktywnych Klientów przekracza limit Planu Darmowego, dotychczasowi Klienci działają dalej bez zmian. Zablokowane jest wyłącznie zapraszanie nowych Klientów. Nie odłączamy Klientów automatycznie.
- Limity są weryfikowane po stronie serwera. Interfejs Aplikacji jest tylko informacją o limicie, a nie jego źródłem.
§ 11. Subskrypcja i to, że sprzedaje ją Apple albo Google
- Subskrypcję wykupuje Trener. Klient Trenera nie płaci nam za korzystanie z Aplikacji. Możliwość wykupienia Subskrypcji przez Użytkownika Samodzielnego jest planowana; jeżeli i kiedy zostanie udostępniona, będzie objęta tym samym Regulaminem.
- Subskrypcja jest sprzedawana wyłącznie w Aplikacji, przez App Store albo Google Play. Zakup odbywa się w panelu płatności sklepu — Apple albo Google — na urządzeniu.
- Sprzedawcą wobec kupującego jest Apple (przy zakupie w App Store) albo Google (przy
zakupie w Google Play). Oznacza to, że:
- Apple lub Google, a nie my, przyjmuje płatność;
- Apple lub Google, a nie my, wystawia kupującemu potwierdzenie zakupu i dokument rozliczeniowy;
- Apple lub Google, a nie my, obsługuje metodę płatności, walutę, podatki i przeliczenia;
- Apple lub Google, a nie my, rozpatruje i realizuje zwroty (§ 13);
- anulowanie Subskrypcji odbywa się w sklepie zakupu — w ustawieniach App Store albo w Google Play, w sekcji Subskrypcje — a nie w Aplikacji (§ 12).
- My otrzymujemy od Apple lub Google, za pośrednictwem dostawcy z § 8.5, potwierdzenie zakupu i status Subskrypcji, i na tej podstawie włączamy uprawnienia na Koncie. Nie mamy dostępu do danych Twojej karty ani do Twojej metody płatności.
- Ceny ustala i wyświetla App Store lub Google Play w Twojej walucie, wraz z należnymi podatkami. Ceny mogą się zmieniać; o zmianie ceny dla trwającej Subskrypcji informuje Apple lub Google na swoich zasadach, a zmiana wymagająca Twojej zgody nie wchodzi w życie bez tej zgody.
- Subskrypcja odnawia się automatycznie na kolejny okres rozliczeniowy (miesięczny albo roczny, zgodnie z wybranym produktem), o ile nie zostanie anulowana najpóźniej 24 godziny przed końcem bieżącego okresu. Opłatę pobiera Apple lub Google w ciągu 24 godzin przed początkiem nowego okresu.
- Jeżeli oferowany jest okres próbny, jego długość i warunki są wskazane przy zakupie. Uprawnienie do okresu próbnego weryfikuje Apple lub Google, nie my. Niewykorzystana część okresu próbnego przepada w chwili wykupienia Subskrypcji.
- Zmiana planu: podwyższenie działa od razu, z proporcjonalnym rozliczeniem po stronie Apple lub Google. Obniżenie planu oraz zmiana okresu rozliczeniowego wchodzą w życie z początkiem następnego okresu rozliczeniowego.
- Nieudana płatność: jeżeli Apple lub Google nie może pobrać opłaty, Subskrypcja może przejść w okres karencji albo w okres wstrzymania. Po bezskutecznym upływie tych okresów Subskrypcja wygasa, a Konto przechodzi na Plan Darmowy — bez utraty danych.
- Przywracanie zakupów: Subskrypcja kupiona przez konto Apple lub konto Google może być przywrócona na Koncie w Aplikacji. Jedna Subskrypcja ze sklepu może być w danym czasie przypisana tylko do jednego Konta w Aplikacji. Przywrócenie jej na inne Konto przenosi ją tam, a Konto dotychczasowe przechodzi na Plan Darmowy. Zanim to nastąpi, poprosimy o potwierdzenie, a Konto tracące Subskrypcję zostanie powiadomione e-mailem.
- Jeżeli aktywna Subskrypcja istnieje jednocześnie na dwóch kanałach sklepowych, Aplikacja ostrzeże o podwójnym obciążeniu. Anulowanie zbędnej Subskrypcji następuje po stronie właściwego sklepu.
- Dokument rozliczeniowy wystawia sprzedawca, czyli Apple lub Google, na swoich zasadach i za pośrednictwem swoich narzędzi. Nie wystawiamy faktur za Subskrypcję i nie mamy technicznej możliwości ich wystawienia.
§ 12. Anulowanie Subskrypcji
- Subskrypcję kupioną w App Store anulujesz w ustawieniach App Store na swoim urządzeniu, w sekcji subskrypcji konta Apple, a Subskrypcję kupioną w Google Play — w aplikacji Google Play, w sekcji Subskrypcje. Aplikacja udostępnia skrót otwierający właściwy ekran, ale samo anulowanie następuje po stronie Apple lub Google.
- Anulowanie wyłącza automatyczne odnawianie. Dostęp zachowujesz do końca opłaconego okresu rozliczeniowego. Po jego zakończeniu Konto przechodzi na Plan Darmowy.
- Anulowanie Subskrypcji nie usuwa Konta ani danych (§ 20) i nie jest samo w sobie żądaniem zwrotu (§ 13).
- Nie możemy anulować Subskrypcji za Ciebie — nie mamy takiej możliwości technicznej ani po stronie App Store, ani po stronie Google Play.
§ 13. Zwroty i prawo odstąpienia
- Zwroty realizuje sprzedawca — Apple albo Google. Wniosek o zwrot Subskrypcji kupionej w App Store składa się do Apple (np. przez reportaproblem.apple.com albo ustawienia konta Apple), a Subskrypcji kupionej w Google Play — do Google, zgodnie z polityką zwrotów Google Play. Decyzję podejmuje sprzedawca według swoich zasad. Nie mamy możliwości przyznania ani zrealizowania zwrotu za Apple ani za Google.
- Jeżeli Apple lub Google zwróci opłatę, uprawnienia na Koncie zostaną odpowiednio wyłączone lub obniżone niezwłocznie po otrzymaniu informacji o zwrocie. Konto przechodzi wtedy na Plan Darmowy — bez utraty danych.
- Prawo odstąpienia (konsumenci). Konsumentowi zawierającemu umowę na odległość przysługuje ustawowe prawo odstąpienia w terminie 14 dni. W przypadku Subskrypcji dotyczy to umowy zawartej z Apple albo Google jako sprzedawcą, dlatego odstąpienie i zwrot środków realizowane są w trybie z ust. 1, na zasadach odpowiednio Apple albo Google i przepisów właściwych dla tej umowy.
- Prawo odstąpienia od umowy z nami. Umowa o prowadzenie Konta (§ 5 ust. 5) jest zawierana z nami i jest nieodpłatna. Konsument może od niej odstąpić w terminie 14 dni od jej zawarcia bez podania przyczyny, składając oświadczenie na contact@movebuddy.pl. Może też w każdej chwili usunąć Konto (§ 20) — jest to prostsza droga do tego samego skutku i nie jest ograniczona terminem.
- Rozpoczęcie korzystania z Usługi na wyraźne żądanie konsumenta przed upływem terminu do odstąpienia nie pozbawia go prawa odstąpienia, ale — w zakresie świadczeń odpłatnych — może wiązać się z obowiązkiem zapłaty za świadczenie spełnione do chwili odstąpienia, na zasadach ustawy o prawach konsumenta.
§ 14. Subskrypcje przyznawane przez nas nieodpłatnie
- Możemy przyznać Kontu uprawnienia płatnego planu nieodpłatnie — na przykład w programie testowym, w ramach współpracy partnerskiej albo jako rekompensatę w postępowaniu reklamacyjnym. Takie uprawnienie nie pochodzi z App Store ani z Google Play i nie jest zakupem.
- Nieodpłatne uprawnienie ma określony termin końcowy i wygasa z jego upływem bez odnowienia. Po wygaśnięciu Konto przechodzi na Plan Darmowy — bez utraty danych.
- Nieodpłatne uprawnienie jest przyznawane w naszym uznaniu, jest niezbywalne, nie ma wartości pieniężnej i nie podlega wymianie na pieniądze.
- Możemy odwołać nieodpłatne uprawnienie przed terminem. O odwołaniu informujemy z 7-dniowym wyprzedzeniem, a w razie naruszenia Regulaminu albo ustania podstawy przyznania — ze skutkiem natychmiastowym.
- Posiadanie nieodpłatnego uprawnienia obok Subskrypcji ze sklepu nie jest podwójnym obciążeniem i nie uprawnia do zwrotu.
§ 15. Treści Użytkownika i licencja, której potrzebujemy
- Treści Użytkownika należą do Użytkownika. Nie nabywamy praw autorskich do Twoich zdjęć, nagrań, planów, ćwiczeń, notatek ani wiadomości.
- Abyśmy mogli świadczyć Usługę, potrzebujemy licencji. Wysyłając Treści Użytkownika do Aplikacji, udzielasz nam niewyłącznej, nieodpłatnej, nieograniczonej terytorialnie licencji, ograniczonej do zakresu niezbędnego do świadczenia Usługi, na następujących polach eksploatacji: utrwalanie i zwielokrotnianie dowolną techniką, w tym techniką cyfrową; wprowadzanie do pamięci komputerów i serwerów; przechowywanie i zwielokrotnianie na potrzeby kopii zapasowych oraz zapewnienia ciągłości i bezpieczeństwa działania; przetwarzanie techniczne (zmiana formatu, kompresja, zmiana rozdzielczości, wygenerowanie miniatury lub klatki podglądu, usunięcie metadanych); przesyłanie w sieciach teleinformatycznych; publiczne udostępnianie w taki sposób, aby osoby wskazane w § 8.4 mogły uzyskać do nich dostęp w wybranym przez siebie miejscu i czasie.
- Licencja obejmuje prawo udzielania dalszych licencji (sublicencji) naszym podwykonawcom technicznym wskazanym w § 8.5, wyłącznie w zakresie niezbędnym do świadczenia Usługi, oraz zezwolenie na wykonywanie i zezwalanie na wykonywanie praw zależnych do opracowań powstałych wyłącznie wskutek czynności technicznych wymienionych w ust. 2.
- Użytkownik zobowiązuje się do niewykonywania wobec nas autorskich praw osobistych w zakresie prawa do nienaruszalności treści i formy utworu oraz do oznaczania autorstwa — w zakresie niezbędnym do czynności z ust. 2 i 3. Prawa te pozostają niezbywalne.
- Licencja jest udzielona wyłącznie w celu świadczenia Usługi. Nie obejmuje wykorzystania Twoich Treści w materiałach marketingowych, publikacji ani udostępnienia komukolwiek poza zakresem z § 8.4.
- Licencja wygasa z chwilą usunięcia Treści albo Konta, z tym że pozostaje w mocy:
- przez czas niezbędny do dokończenia usuwania (§ 20 ust. 6);
- w zakresie Treści niezbędnych do ustalenia, dochodzenia lub obrony roszczeń — do upływu terminu przedawnienia tych roszczeń;
- w zakresie danych zanonimizowanych i zestawień zbiorczych — bez ograniczenia czasowego, przy czym dane te nie pozwalają zidentyfikować Użytkownika.
- Użytkownik oświadcza, że ma prawo do przesyłanych Treści i że ich przesłanie nie narusza praw osób trzecich. W szczególności Użytkownik nie przesyła zdjęć, nagrań ani wizerunku innych osób bez ich zgody.
- Materiały tworzone przez Trenera — szablony planów, ćwiczenia, szablony ankiet — pozostają materiałami Trenera. Trener zachowuje je po zakończeniu Współpracy i po usunięciu Konta przez Klienta, o ile nie identyfikują one tego Klienta.
- Możemy usunąć lub zablokować Treści naruszające prawo albo § 16, po uzyskaniu wiarygodnej wiadomości o ich bezprawnym charakterze, w trybie § 16a.
- Feedback. Uwagi, sugestie, propozycje usprawnień, zgłoszenia błędów i pomysły dotyczące Aplikacji, przekazane nam przez Użytkownika w dowolnej formie, przekazywane są dobrowolnie i nieodpłatnie. Możemy z nich korzystać bez ograniczeń — w szczególności je wdrażać, rozwijać, modyfikować, łączyć z własnymi rozwiązaniami i wykorzystywać komercyjnie — bez obowiązku zapłaty wynagrodzenia, wskazania autorstwa, zachowania poufności ani informowania o sposobie wykorzystania.
- Jeżeli Feedback stanowi utwór, Użytkownik udziela nam do niego niewyłącznej, nieodpłatnej, nieograniczonej czasowo i terytorialnie licencji, z prawem udzielania sublicencji, na polach eksploatacji: utrwalanie i zwielokrotnianie dowolną techniką; wprowadzanie do pamięci komputerów; wprowadzanie do obrotu; publiczne udostępnianie w taki sposób, aby każdy mógł mieć do niego dostęp w wybranym przez siebie miejscu i czasie; a także zezwala na wykonywanie i zezwalanie na wykonywanie praw zależnych. Postanowień ust. 10–11 nie stosuje się do Treści Użytkownika.
§ 15a. Nasze prawa i licencja dla Użytkownika
- Aplikacja — jej kod źródłowy i wynikowy, interfejs, struktura, szata graficzna, dokumentacja, nazwa i logotyp MoveBuddy, materiały biblioteki ćwiczeń oraz bazy danych — stanowi przedmiot naszych praw wyłącznych albo praw naszych licencjodawców. Bazy danych Aplikacji podlegają ochronie na podstawie ustawy o ochronie baz danych.
- Z chwilą utworzenia Konta udzielamy Użytkownikowi niewyłącznej, niezbywalnej, odwołalnej licencji na korzystanie z Aplikacji na urządzeniu, którego jest właścicielem lub użytkownikiem, wyłącznie na własny użytek i wyłącznie w celu korzystania z Usługi zgodnie z Regulaminem, na czas trwania umowy. Licencja nie obejmuje prawa do udzielania sublicencji, najmu, dzierżawy, użyczenia, odsprzedaży ani udostępniania Aplikacji osobom trzecim.
- Regulamin nie przenosi na Użytkownika żadnych praw własności intelektualnej. Wszystkie prawa nieudzielone wyraźnie pozostają przy nas.
- Użytkownik nie usuwa ani nie zmienia oznaczeń praw autorskich, znaków towarowych i innych oznaczeń identyfikujących zamieszczonych w Aplikacji.
- Użytkownik nie korzysta z naszej nazwy, znaków towarowych ani logotypów bez naszej uprzedniej zgody wyrażonej co najmniej w formie dokumentowej, z wyjątkiem zgodnej z prawdą informacji o korzystaniu z Aplikacji.
- Zakaz z § 16 pkt 10 nie narusza uprawnień przysługujących Użytkownikowi na podstawie art. 75 ust. 2 i 3 ustawy o prawie autorskim i prawach pokrewnych.
§ 16. Zakazane korzystanie z Aplikacji
Zabronione jest:
- korzystanie z Aplikacji w sposób sprzeczny z prawem, Regulaminem albo dobrymi obyczajami;
- przesyłanie treści bezprawnych, obraźliwych, nienawistnych, nakłaniających do przemocy, pornograficznych, a także treści przedstawiających osoby małoletnie w kontekście seksualnym;
- przesyłanie zdjęć, nagrań lub wizerunku innej osoby bez jej zgody, w szczególności zdjęć sylwetki innej osoby;
- nękanie, zastraszanie lub uporczywe kontaktowanie się z inną osobą przez czat;
- udostępnianie Konta lub danych logowania innej osobie, a także zakładanie Konta na dane innej osoby;
- korzystanie z Aplikacji przez osobę, która nie ukończyła 16 lat;
- dodawanie do listy Klientów osób, o których Trener nie wie, czy chcą z nim współpracować, a w szczególności podawanie adresów e-mail osób, które nie wyraziły zainteresowania współpracą;
- obchodzenie limitów Planu Darmowego, mechanizmów Subskrypcji, weryfikacji zakupu albo uprawnień, w tym przez zakładanie wielu Kont w celu obejścia limitu Klientów;
- automatyczne pobieranie danych (scraping), masowe zapytania, testy obciążeniowe oraz próby uzyskania nieuprawnionego dostępu do Aplikacji, kont innych osób lub naszej infrastruktury;
- dekompilacja, deasemblacja i inżynieria odwrotna Aplikacji w zakresie szerszym niż dozwolony bezwzględnie obowiązującymi przepisami;
- wprowadzanie do Aplikacji złośliwego oprogramowania;
- odsprzedaż, wynajem lub udostępnianie Usługi podmiotom trzecim jako własnej usługi, a także korzystanie z jednego Konta Trenera przez wielu trenerów;
- wykorzystywanie danych Klientów uzyskanych w Aplikacji do celów innych niż świadczenie im usług trenerskich;
- podawanie się za inną osobę lub za pracownika Usługodawcy oraz rozpowszechnianie nieprawdziwych informacji o Usłudze;
- korzystanie z Aplikacji w celu udzielania porad medycznych, diagnozowania lub leczenia;
- wykorzystywanie Aplikacji, jej funkcji, danych lub dokumentacji do tworzenia, rozwijania albo ulepszania produktu lub usługi konkurencyjnej, a także udostępnianie dostępu do Aplikacji podmiotowi prowadzącemu działalność konkurencyjną wobec Usługodawcy;
- przeprowadzanie testów porównawczych, testów wydajnościowych i analiz konkurencyjnych Aplikacji oraz publikowanie ich wyników bez naszej uprzedniej zgody wyrażonej co najmniej w formie dokumentowej;
- korzystanie z Aplikacji za pośrednictwem zautomatyzowanych narzędzi, interfejsów innych niż przez nas udostępnione albo integrowanie Aplikacji z innymi systemami bez naszej zgody;
- podejmowanie działań zmierzających do obejścia zabezpieczeń, ograniczeń dostępu, weryfikacji uprawnień albo mechanizmów kontroli limitów, a także pomaganie w tym innym osobom.
Naruszenie tego paragrafu uprawnia nas do działań opisanych w § 18 ust. 5 oraz do dochodzenia kar umownych (§ 16b) i naprawienia szkody na zasadach ogólnych.
§ 16a. Zgłaszanie treści bezprawnych i decyzje moderacyjne
- Każda osoba i każdy podmiot może zgłosić nam treść uznawaną za bezprawną, wysyłając zgłoszenie na adres contact@movebuddy.pl. Zgłoszenie powinno zawierać: dostatecznie uzasadnione wyjaśnienie powodów, dla których treść jest bezprawna; dokładne wskazanie umożliwiające jej zlokalizowanie (identyfikator Konta lub wiadomości, data i godzina); imię i nazwisko albo nazwę oraz adres e-mail zgłaszającego — z wyjątkiem zgłoszeń dotyczących przestępstw, o których mowa w art. 3–7 dyrektywy 2011/93/UE; oraz oświadczenie o powzięciu w dobrej wierze przekonania, że informacje zawarte w zgłoszeniu są prawidłowe i kompletne.
- Potwierdzamy otrzymanie zgłoszenia i rozpatrujemy je terminowo, w sposób niearbitralny, obiektywny i z zachowaniem należytej staranności. O naszej decyzji informujemy zgłaszającego, a jeżeli podejmujemy działanie wobec treści albo Konta — również Użytkownika, którego działanie dotyczy, w trybie § 18 ust. 5.
- Zgłoszenie zawierające elementy wskazane w ust. 1 daje nam wiarygodną wiadomość o bezprawnym charakterze treści, jeżeli pozwala stwierdzić tę bezprawność bez szczegółowej analizy prawnej.
- Punktem kontaktowym dla użytkowników oraz dla organów państw członkowskich, Komisji Europejskiej i Rady Usług Cyfrowych, w rozumieniu art. 11 i 12 rozporządzenia (UE) 2022/2065, jest adres contact@movebuddy.pl. Językiem komunikacji jest język polski, a w kontaktach z organami także język angielski.
- Nie prowadzimy uprzedniej moderacji ani stałego monitorowania treści wymienianych między Trenerem a Klientem i nie mamy obowiązku ich poszukiwania (art. 8 rozporządzenia (UE) 2022/2065). Decyzje podejmujemy na podstawie zgłoszeń, nakazów organów albo powziętej wiadomości.
- Do zgłoszeń dotyczących naruszeń praw autorskich, dóbr osobistych i wizerunku stosuje się ust. 1–3.
§ 16b. Kary umowne
Ten paragraf stosuje się wyłącznie do Użytkowników będących Przedsiębiorcami. Nie stosuje się go do konsumentów ani do osób, o których mowa w art. 3855 k.c.
- Użytkownik będący Przedsiębiorcą, który narusza § 16 pkt 8, 9, 12, 13 lub 16–19, zapłaci nam karę umowną w wysokości 5000 zł za każde naruszenie, a w przypadku naruszenia o charakterze ciągłym — za każdy rozpoczęty miesiąc jego trwania.
- Zapłata kary umownej nie wyłącza dochodzenia odszkodowania przenoszącego jej wysokość na zasadach ogólnych.
- Kara umowna jest płatna w terminie 14 dni od dnia doręczenia wezwania.
§ 17. Dostępność Usługi, przerwy i zmiany w Aplikacji
- Dokładamy starań, aby Aplikacja działała nieprzerwanie, ale nie zobowiązujemy się do określonego poziomu dostępności (SLA), o ile nie uzgodniono go odrębnie na piśmie.
- Możemy wprowadzać planowane przerwy techniczne. Jeżeli przewidujemy, że przerwa potrwa dłużej niż 24 godziny, poinformujemy o niej z wyprzedzeniem w Aplikacji lub e-mailem.
- Możliwe są nieplanowane przerwy — awarie, incydenty bezpieczeństwa, awarie u dostawców z § 8.5, działanie siły wyższej. Usuwamy je niezwłocznie po wykryciu.
- Usługa zależy od dostawców zewnętrznych (App Store, Google Play, dostawca uwierzytelniania i bazy danych, magazyn plików, operatorzy powiadomień push). Skutki ich awarii oceniane są na zasadach § 17a oraz § 18.
- Aplikacja jest rozwijana — dodajemy, zmieniamy i wycofujemy funkcje. Zmiany ulepszające Usługę, poprawiające bezpieczeństwo lub wynikające z obowiązków prawnych możemy wprowadzać bez uprzedzenia, jeżeli nie ograniczają istotnie zakresu Usługi.
- Jeżeli zamierzamy istotnie ograniczyć lub wycofać funkcję, z której korzystasz, poinformujemy o tym co najmniej 30 dni wcześniej w Aplikacji lub e-mailem. Nie gwarantujemy, że dowolna konkretna funkcja będzie dostępna bezterminowo.
- Zalecamy, aby Użytkownik nie traktował Aplikacji jako jedynego miejsca przechowywania danych, które są dla niego niezastąpione — w szczególności aby zachował własne kopie ważnych zdjęć.
§ 17a. Siła wyższa
- Nie ponosimy odpowiedzialności za niewykonanie lub nienależyte wykonanie Usługi w zakresie, w jakim jest ono następstwem siły wyższej. Bieg terminów naszych zobowiązań ulega zawieszeniu na czas trwania siły wyższej i jej bezpośrednich skutków.
- Przez siłę wyższą rozumie się zdarzenie zewnętrzne, niemożliwe do przewidzenia i takie, którego skutkom nie można było zapobiec przy zachowaniu należytej staranności, w szczególności: klęskę żywiołową, pożar, powódź, wojnę, atak terrorystyczny lub cyberatak o charakterze powszechnym, akt władzy publicznej, sankcje, powszechną awarię sieci energetycznej lub telekomunikacyjnej, strajk generalny, epidemię, a także rozległą awarię albo zaprzestanie świadczenia usług przez dostawcę infrastruktury, od której Usługa zależy, jeżeli zdarzenie to samo spełnia przesłanki zdania pierwszego i nie mieliśmy realnej możliwości zastąpienia tego dostawcy w rozsądnym czasie.
- O wystąpieniu siły wyższej informujemy niezwłocznie w Aplikacji lub e-mailem i podejmujemy działania zmierzające do ograniczenia jej skutków.
- Jeżeli stan siły wyższej trwa nieprzerwanie dłużej niż 60 dni, każda ze stron może rozwiązać umowę ze skutkiem natychmiastowym, bez odszkodowania.
§ 18. Odpowiedzialność
- Odpowiadamy za niewykonanie lub nienależyte wykonanie Usługi na zasadach ogólnych, w zakresie wynikającym z przepisów prawa. Postanowienia tego paragrafu nie wyłączają ani nie ograniczają odpowiedzialności, której na mocy przepisów bezwzględnie obowiązujących wyłączyć ani ograniczyć nie można — w szczególności odpowiedzialności za szkodę wyrządzoną umyślnie, za szkodę na osobie oraz odpowiedzialności wobec konsumenta w zakresie zgodności świadczenia z umową.
- Nie odpowiadamy za:
- treść i skutki planu treningowego ani za sposób jego wykonania — odpowiada za nie autor planu (Trener albo sam Użytkownik) oraz osoba trenująca;
- działania i zaniechania Trenera, jakość jego usług, jego kwalifikacje, rozliczenia z Klientem oraz wykonanie umowy między Trenerem a Klientem;
- prawidłowość danych wprowadzonych przez Użytkownika i wyników obliczeń opartych na tych danych;
- treści przesyłane przez Użytkowników między sobą;
- działanie urządzenia Użytkownika, jego systemu operacyjnego, sieci ani oprogramowania osób trzecich.
- Nie gwarantujemy rezultatu treningowego (§ 3 ust. 6). Brak oczekiwanego efektu nie jest nienależytym wykonaniem Usługi.
- Ograniczenie odpowiedzialności wobec Przedsiębiorców.
Ten ustęp stosuje się wyłącznie do Użytkowników będących Przedsiębiorcami — w tym Trenerów. Nie stosuje się go do konsumentów ani do osób, o których mowa w art. 3855 k.c.
- odpowiadamy wyłącznie za szkodę wyrządzoną z winy umyślnej albo wskutek rażącego niedbalstwa; odpowiedzialność za szkodę wyrządzoną z winy nieumyślnej niestanowiącej rażącego niedbalstwa zostaje wyłączona;
- odpowiadamy wyłącznie za szkodę rzeczywistą; wyłączamy odpowiedzialność za utracone korzyści, utratę przychodu, utratę klientów lub kontraktów, utratę renomy, utratę, uszkodzenie lub niedostępność danych oraz koszty ich odtworzenia, przerwy w działalności, a także za szkody pośrednie i następcze;
- wyłączamy odpowiedzialność za roszczenia osób trzecich skierowane do Użytkownika, w tym roszczenia Klientów Trenera związane z usługą trenerską, treścią planu, jakością opieki lub rozliczeniami;
- nasza łączna odpowiedzialność z tytułu wszystkich zdarzeń zaistniałych w okresie kolejnych 12 miesięcy jest ograniczona do sumy opłat za Subskrypcję zapłaconych przez tego Użytkownika w okresie 12 miesięcy poprzedzających zdarzenie; jeżeli Użytkownik nie uiścił żadnych opłat — w szczególności korzystał z Planu Darmowego albo z uprawnienia przyznanego nieodpłatnie — odpowiedzialność jest ograniczona do kwoty 500 zł;
- Użytkownik zgłasza nam szkodę niezwłocznie po jej stwierdzeniu, nie później niż w terminie 30 dni, na adres z § 2 ust. 2, wskazując datę, godzinę i okoliczności zdarzenia. Zgłoszenie po tym terminie nie pozbawia roszczenia, jednak Użytkownik przyjmuje do wiadomości, że techniczne zapisy zdarzeń przechowywane są przez ograniczony czas (§ 23 ust. 10);
- Ograniczenia i wyłączenia z niniejszego ustępu nie dotyczą szkody wyrządzonej umyślnie — zastrzeżenie, że dłużnik nie będzie odpowiedzialny za szkodę wyrządzoną wierzycielowi umyślnie, jest nieważne (art. 473 § 2 k.c.). Nie dotyczą one także odpowiedzialności, której nie można wyłączyć ani ograniczyć na podstawie przepisów bezwzględnie obowiązujących.
- Blokada i rozwiązanie za naruszenie. W razie naruszenia § 16 możemy — proporcjonalnie do naruszenia — wezwać do jego zaprzestania, usunąć sporne Treści, ograniczyć funkcje Konta, zawiesić Konto albo rozwiązać umowę. Przed zawieszeniem lub rozwiązaniem wzywamy do zaprzestania naruszenia i wyznaczamy termin nie krótszy niż 7 dni, chyba że naruszenie jest rażące, powtarza się, stanowi czyn zabroniony albo zagraża bezpieczeństwu Usługi lub innych Użytkowników — wtedy możemy działać natychmiast. Wobec Użytkownika będącego Przedsiębiorcą możemy zawiesić Konto albo rozwiązać umowę ze skutkiem natychmiastowym, bez uprzedniego wezwania i bez wyznaczania terminu. O każdej decyzji o usunięciu Treści, ograniczeniu funkcji, zawieszeniu Konta albo rozwiązaniu umowy informujemy Użytkownika, wskazując zakres i rodzaj ograniczenia, jego podstawę faktyczną i podstawę w Regulaminie, informację o ewentualnym użyciu narzędzi automatycznych oraz pouczenie o trybie odwołania (§ 19) i o możliwości dochodzenia praw przed sądem.
- Zawieszenie Konta nie powoduje usunięcia danych Użytkownika. Po ustaniu przyczyny zawieszenia przywracamy dostęp do Konta. Zawieszenie nie uprawnia do zwrotu opłat ani do odszkodowania, chyba że okazało się bezpodstawne.
- Naruszenie Regulaminu przez Trenera nie wpływa na Konta jego Klientów, a naruszenie przez Klienta nie wpływa na Konto jego Trenera.
§ 18a. Zakres świadczenia, rękojmia i gwarancja
- Usługa jest udostępniana w takim stanie i zakresie funkcjonalnym, w jakim jest dostępna w danym czasie. Nie zapewniamy, że Aplikacja będzie wolna od błędów, że będzie działać nieprzerwanie ani że spełni indywidualne oczekiwania Użytkownika co do przydatności do określonego celu.
- Nasze świadczenie nie obejmuje: archiwizacji danych na zlecenie Użytkownika, prowadzenia kopii zapasowych na jego rzecz, odtworzenia danych utraconych z przyczyn leżących po stronie Użytkownika, jego urządzenia lub dostawców zewnętrznych, ani zapewnienia zgodności Aplikacji z oprogramowaniem i urządzeniami osób trzecich.
- Wobec Użytkowników będących Przedsiębiorcami wyłączamy rękojmię oraz wszelkie gwarancje, wyraźne i dorozumiane, w najszerszym zakresie dopuszczalnym przez prawo.
- Ustępu 3 nie stosuje się do konsumentów ani do osób, o których mowa w art. 3855 k.c. Wobec konsumenta stosuje się przepisy o zgodności treści cyfrowej lub usługi cyfrowej z umową, których niniejszy Regulamin nie wyłącza ani nie ogranicza.
§ 19. Reklamacje
- Reklamację można złożyć w każdej sprawie dotyczącej Usługi, na adres contact@movebuddy.pl albo pisemnie na adres z § 2 ust. 2.
- Reklamacja powinna zawierać: dane pozwalające zidentyfikować Konto (adres e-mail), opis problemu, datę jego wystąpienia oraz oczekiwany sposób rozpatrzenia. Brak któregokolwiek z tych elementów nie jest przeszkodą do rozpatrzenia reklamacji.
- Reklamację konsumenta rozpatrujemy w terminie 14 dni od jej otrzymania i w tym terminie udzielamy odpowiedzi. Brak odpowiedzi w terminie 14 dni na reklamację konsumenta oznacza jej uznanie.
- Reklamację Użytkownika niebędącego konsumentem ani osobą, o której mowa w art. 3855 k.c., rozpatrujemy w terminie 30 dni. Skutku wskazanego w ust. 3 zdanie ostatnie nie stosuje się do takich Użytkowników.
- Reklamacje dotyczące płatności, zwrotów i anulowania Subskrypcji należy kierować do Apple lub Google (§ 12–§ 13). Jeżeli reklamacja dotyczy uprawnień na Koncie po zakupie — rozpatrujemy ją my.
- Pozasądowe rozwiązywanie sporów (konsumenci). Konsument może skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, w szczególności: mediacji przy wojewódzkim inspektoracie Inspekcji Handlowej, stałego sądu konsumenckiego, pomocy powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej działającej na rzecz konsumentów. Skorzystanie z tych trybów jest dobrowolne i nie pozbawia prawa do sądu.
- Punkt kontaktowy Prezesa Urzędu Ochrony Konkurencji i Konsumentów: uokik.gov.pl.
§ 20. Rozwiązanie umowy i usunięcie Konta
- Klient i Użytkownik Samodzielny mogą w każdej chwili rozwiązać umowę, bez podania przyczyny i bez okresu wypowiedzenia, usuwając Konto w Aplikacji.
- Usunięcie Konta Klienta wymaga uprzedniego zakończenia Współpracy. Klient może ją zakończyć sam, bez zgody Trenera (§ 9 ust. 1).
- Konto Trenera. Ponieważ wewnętrzny profil Klienta Trenera (§ 6 ust. 5) jest trwały i nie można go zakończyć, Trener usuwa Konto przez zgłoszenie żądania na contact@movebuddy.pl; wykonujemy je bez zbędnej zwłoki i nie później niż w terminie 30 dni od otrzymania żądania. Skutki i zakres usunięcia są takie same jak w ust. 5–8.
- Możemy wypowiedzieć umowę z zachowaniem 30-dniowego okresu wypowiedzenia z ważnych przyczyn, którymi są: zaprzestanie świadczenia Usługi albo jej istotnej części; istotna zmiana modelu świadczenia lub odpłatności Usługi; trwała utrata technicznej, prawnej albo ekonomicznej możliwości świadczenia Usługi na dotychczasowych zasadach, w tym wskutek zmiany warunków lub zakończenia współpracy przez dostawcę, od którego Usługa zależy; zmiana przepisów prawa albo wymagań App Store lub Google Play uniemożliwiająca dalsze świadczenie Usługi w dotychczasowym kształcie; a także korzystanie z Usługi w sposób powodujący trwale nieproporcjonalne obciążenie naszej infrastruktury. O wypowiedzeniu informujemy e-mailem, podając przyczynę. W okresie wypowiedzenia Konto pozostaje dostępne, a Użytkownik może samodzielnie zapisać swoje dane. Jeżeli wypowiedzenie następuje w trakcie opłaconego okresu rozliczeniowego, uprawnienia płatnego planu zachowujemy do końca tego okresu. Rozwiązanie umowy z powodu naruszenia Regulaminu następuje w trybie § 18 ust. 5.
- Konto nieaktywne. Konto, na którym przez 24 kolejne miesiące nie zalogowano się ani nie wykonano żadnej czynności, możemy usunąć wraz z danymi. Przed usunięciem wysyłamy dwa zawiadomienia na adres e-mail przypisany do Konta — pierwsze na 30 dni, drugie na 7 dni przed planowanym usunięciem. Zalogowanie się przed upływem terminu przerywa bieg okresu. Skutki usunięcia określają ust. 6–9.
- Usunięcie Konta odbiera dostęp natychmiast. Z chwilą potwierdzenia żądania tracisz możliwość zalogowania się, a Konto przestaje być widoczne w Aplikacji dla kogokolwiek, w tym dla Twojego dotychczasowego Trenera.
- Fizyczne usuwanie danych jest procesem, nie chwilą. Po odebraniu dostępu usuwamy dane w tle: najpierw rekordy w bazie danych, potem pliki w magazynie plików, potem tożsamość u dostawcy uwierzytelniania. Proces jest ponawiany do zakończenia. Od momentu potwierdzenia żądania nikt nie ma już dostępu do tych danych.
- Co usuwamy: wszystkie treningi, serie i wykonania; przypisane plany; przypisane ankiety wraz z odpowiedziami; cele; pomiary ciała; Zdjęcia Postępów; notatki Trenera o Tobie; wydarzenia w kalendarzu i serie cykliczne; całą rozmowę na czacie, w tym wiadomości Trenera; zapisy Współpracy wraz z wpisem w archiwum Trenera. Trener zachowuje wyłącznie materiały, które sam utworzył i które Ciebie nie identyfikują.
- Co pozostaje i dlaczego:
- pseudonimowy zapis samego usunięcia — identyfikator niezawierający danych osobowych, data żądania i data zakończenia;
- dane niezbędne do ustalenia, dochodzenia lub obrony roszczeń — imię, nazwisko, adres e-mail, daty zawarcia i rozwiązania umowy, oznaczenie zaakceptowanej wersji Regulaminu, historia reklamacji i korespondencji z nami, a w razie zgłoszenia roszczenia albo powstania uzasadnionych podstaw do jego przewidywania także dane niezbędne do obrony przed tym konkretnym roszczeniem, w tym odpowiedzi z Ankiety Wstępnej i zapis rozmowy na czacie. Dane te przechowujemy w ograniczonym dostępie, oddzielone od danych używanych operacyjnie, wyłącznie w tym celu i wyłącznie przez okres przedawnienia roszczeń (art. 17 ust. 3 lit. e RODO, a w zakresie danych o zdrowiu — art. 9 ust. 2 lit. f RODO);
- rekordy Subskrypcji i zdarzeń rozliczeniowych, po odłączeniu ich od Twojej tożsamości; okres retencji: 5 lat od końca roku podatkowego, w którym upłynął termin płatności podatku;
- dokumentacja rozliczeniowa i podatkowa, w zakresie i przez okres wynikający z przepisów o rachunkowości i przepisów podatkowych;
- pseudonimowe identyfikatory w logach technicznych, do końca okresu retencji logów;
- pseudonimowy rekord u dostawcy obsługującego Subskrypcje (§ 8.5), którego usunięcie następuje zgodnie z warunkami tego dostawcy.
- Usunięcie Konta nie anuluje Subskrypcji w App Store ani w Google Play. Subskrypcję trzeba anulować odrębnie (§ 12), inaczej Apple lub Google będzie ją odnawiać.
- Usunięcie Konta jest nieodwracalne. Nie odtwarzamy usuniętych danych, także na wyraźne żądanie. Zalecamy, abyś przed usunięciem Konta samodzielnie zapisał ważne dane — Aplikacja nie ma dziś funkcji eksportu, więc kopię trzeba sporządzić ręcznie.
§ 21. Zmiany Regulaminu
- Możemy zmienić Regulamin, jeżeli zmienia się zakres lub sposób świadczenia Usługi, zmieniają się przepisy prawa albo wymagania dostawców, od których Usługa zależy (w szczególności Apple lub Google), zmienia się model odpłatności, albo gdy zmiana jest konieczna dla bezpieczeństwa Usługi lub usunięcia niejasności.
- O zmianie informujemy co najmniej 30 dni przed jej wejściem w życie — w Aplikacji oraz e-mailem na adres przypisany do Konta. W informacji wskazujemy, co się zmienia, i podajemy datę wejścia zmiany w życie.
- Jeżeli nie zgadzasz się na zmianę, możesz rozwiązać umowę przed dniem jej wejścia w życie — przez usunięcie Konta albo przez oświadczenie na contact@movebuddy.pl. Rozwiązanie umowy w tym trybie jest bezpłatne. Brak sprzeciwu do dnia wejścia zmiany w życie i dalsze korzystanie z Aplikacji oznaczają przyjęcie zmienionego Regulaminu.
- Zmiana Regulaminu nie zmienia warunków Subskrypcji już opłaconego okresu rozliczeniowego.
- Zmiany wyłącznie porządkowe (poprawa oczywistej omyłki, aktualizacja danych kontaktowych, doprecyzowanie niezmieniające zakresu praw i obowiązków) wchodzą w życie z chwilą ogłoszenia; informujemy o nich w Aplikacji.
§ 22. Apple jako beneficjent i warunki App Store
- Regulamin jest umową między Użytkownikiem a Usługodawcą, nie z Apple. Apple nie jest stroną tej umowy.
- Apple nie ponosi odpowiedzialności za Aplikację ani za jej treść. Wszelkie roszczenia dotyczące Aplikacji — w tym z tytułu niezgodności z umową, odpowiedzialności za produkt, naruszenia praw osób trzecich lub przepisów o ochronie konsumentów — Użytkownik kieruje do Usługodawcy, a nie do Apple, z zastrzeżeniem uprawnień wynikających wobec Apple z umowy sprzedaży zawartej z Apple (§ 11–§ 13) lub z przepisów bezwzględnie obowiązujących.
- Apple nie ma obowiązku świadczenia wsparcia ani serwisu w odniesieniu do Aplikacji.
- Jeżeli Aplikacja nie jest zgodna z gwarancją mającą zastosowanie w danym sklepie, Użytkownik może powiadomić Apple, a Apple może zwrócić cenę zakupu; w pozostałym zakresie Apple nie ma żadnych zobowiązań gwarancyjnych dotyczących Aplikacji.
- Apple i podmioty z jej grupy są beneficjentami tego Regulaminu w zakresie postanowień niniejszego paragrafu i są uprawnione do ich egzekwowania wobec Użytkownika.
- Użytkownik oświadcza, że nie znajduje się w kraju objętym embargiem oraz że nie widnieje na listach podmiotów objętych sankcjami, w zakresie wymaganym warunkami App Store.
- Korzystanie z Aplikacji pobranej z App Store podlega dodatkowo warunkom korzystania z App Store, a korzystanie z Aplikacji pobranej z Google Play — dodatkowo warunkom korzystania z Google Play.
§ 23. Prawo właściwe, sąd i postanowienia końcowe
- Prawem właściwym dla Regulaminu i dla umowy o świadczenie Usługi jest prawo polskie.
- Wybór prawa polskiego nie pozbawia konsumenta ochrony, jaką zapewniają mu bezwzględnie obowiązujące przepisy prawa państwa jego zwykłego miejsca pobytu.
- Spory z konsumentami rozpoznaje sąd właściwy według przepisów Kodeksu postępowania cywilnego. Nie ograniczamy konsumentowi prawa do sądu ani nie narzucamy sądu właściwego dla naszej siedziby.
- Spory z Użytkownikami będącymi Przedsiębiorcami rozpoznaje sąd właściwy miejscowo dla siedziby Usługodawcy. Sąd ten jest wyłącznie właściwy także w sprawach z Użytkownikami mającymi siedzibę poza Rzecząpospolitą Polską.
- Jeżeli którekolwiek postanowienie Regulaminu okaże się nieważne lub bezskuteczne, pozostałe pozostają w mocy. Postanowienie nieważne zastępuje odpowiedni przepis prawa.
- Postanowienia Regulaminu mniej korzystne dla konsumenta niż przepisy bezwzględnie obowiązujące nie wiążą konsumenta; w ich miejsce stosuje się te przepisy.
- Możemy przenieść prawa i obowiązki wynikające z umowy na inny podmiot,
w szczególności w przypadku połączenia, podziału albo przekształcenia, zbycia przedsiębiorstwa
lub jego zorganizowanej części, a także zmiany podmiotu świadczącego Usługę w ramach grupy
kapitałowej. Przeniesienie nie może pogorszyć warunków świadczenia Usługi ani zakresu praw
Użytkownika. O zamiarze przeniesienia informujemy z co najmniej 30-dniowym wyprzedzeniem,
wskazując podmiot przejmujący i datę przeniesienia; Użytkownik może w tym czasie rozwiązać umowę
w trybie § 21 ust. 3. Wierzytelności przysługujące nam wobec Użytkownika
możemy przenieść bez ograniczeń.
Użytkownik nie może przenieść praw ani obowiązków wynikających z umowy, w szczególności zbyć, wynająć ani udostępnić Konta, bez naszej uprzedniej zgody wyrażonej co najmniej w formie dokumentowej. Konto jest niezbywalne. Użytkownik będący Przedsiębiorcą nie może potrącić swojej wierzytelności z naszą wierzytelnością ani wstrzymać zapłaty należnych nam kwot bez naszej zgody.
- Zasady przetwarzania danych osobowych opisuje Polityka Prywatności, dostępna w Aplikacji i pod adresem https://movebuddy.pl/polityka-prywatnosci. W razie rozbieżności między Regulaminem a Polityką Prywatności w sprawach ochrony danych osobowych pierwszeństwo ma Polityka Prywatności.
- Regulamin sporządzono w języku polskim. W razie sporządzenia wersji w innym języku rozstrzygająca jest wersja polska. Wszelka korespondencja i postępowania prowadzone są w języku polskim.
- Okoliczności dotyczące korzystania z Usługi — w szczególności datę i treść oświadczeń składanych w Aplikacji, datę akceptacji Regulaminu i oznaczenie jego wersji, fakt i czas wykonania czynności w Aplikacji, zakres udostępnionych funkcji oraz przebieg komunikacji z nami — wykazujemy zapisami naszych systemów teleinformatycznych. Zapisy te stanowią dokument w rozumieniu art. 773 k.c. i mogą zostać przedstawione jako dowód. Postanowienie niniejsze nie ogranicza prawa Użytkownika do przedstawienia dowodu przeciwnego ani nie wyłącza żadnego środka dowodowego. Techniczne zapisy zdarzeń przechowujemy przez okres retencji narzędzia monitorującego, wskazany w Polityce Prywatności.
- Oświadczenia i zawiadomienia kierujemy do Użytkownika na adres e-mail przypisany do Konta oraz dodatkowo w Aplikacji. Wiadomość wysłaną na ten adres uważa się za doręczoną z chwilą, w której Użytkownik mógł zapoznać się z jej treścią (art. 61 § 2 k.c.). Użytkownik utrzymuje adres e-mail przypisany do Konta w stanie aktualnym i sprawnym; skutki niedopełnienia tego obowiązku obciążają Użytkownika. Oświadczenia Użytkownika kierowane do nas składa się na adres wskazany w § 2 ust. 2.
§ 24. Kontakt

- Inspektor Ochrony Danych: nie powołaliśmy inspektora ochrony danych. Wszystkie sprawy dotyczące danych osobowych kierujemy na contact@movebuddy.pl.
Załącznik nr 1. Uzgodnienia współadministrowania
Poniższe uzgodnienia stosuje się wyłącznie w zakresie, w jakim organ nadzorczy albo sąd stwierdzi, że Usługodawca i Trener są współadministratorami danych Klienta (§ 7a ust. 6). Jest to zasadnicza treść uzgodnień w rozumieniu art. 26 ust. 2 RODO.
- Podział obowiązków informacyjnych: Usługodawca informuje osobę o przetwarzaniu związanym z prowadzeniem Konta i działaniem Aplikacji (Polityka Prywatności); Trener informuje o przetwarzaniu związanym z własną usługą trenerską, w tym o pytaniach własnych i notatkach.
- Wykonywanie praw osób: osoba może wykonywać swoje prawa wobec każdego ze współadministratorów. Żądania dotyczące danych Konta i działania Aplikacji realizuje Usługodawca; żądania dotyczące danych wprowadzonych przez Trenera realizuje Trener. Adresat żądania niezwłocznie przekazuje je właściwemu współadministratorowi i informuje o tym osobę. Termin odpowiedzi wynosi miesiąc od otrzymania żądania przez pierwszego z nich.
- Bezpieczeństwo: Usługodawca odpowiada za środki techniczne i organizacyjne dotyczące Aplikacji i infrastruktury (art. 32 RODO); Trener odpowiada za bezpieczeństwo dostępu do własnego Konta, urządzeń i za zakres danych, które wprowadza.
- Naruszenia ochrony danych: naruszenie dotyczące Aplikacji i infrastruktury zgłasza organowi Usługodawca; naruszenie po stronie Trenera — Trener. Strony informują się o naruszeniu niezwłocznie, nie później niż w ciągu 24 godzin od jego stwierdzenia.
- Punkt kontaktowy dla osób, których dane dotyczą: contact@movebuddy.pl, bez uszczerbku dla prawa kontaktu bezpośrednio z Trenerem.
- Rozliczenia między współadministratorami: współadministrator, który naprawił szkodę albo zapłacił administracyjną karę pieniężną w części odpowiadającej odpowiedzialności drugiego, może żądać od niego zwrotu tej części (art. 82 ust. 5 RODO).

In short — five things you need to know
This box does not replace the Terms; it summarises their most important rules.
- MoveBuddy is a tool, not a training or medical service. We supply software. We do not create training plans, we do not run training sessions and we do not give health advice.
- The Trainer is an independent service provider. We are not a party to the contract between a Trainer and their Client. We do not verify Trainers' qualifications. The Trainer is responsible for the content of the plan and the quality of their care.
- We store your data and files on our servers. Progress Photos, video, voice messages, body measurements, questionnaire answers (including health-related ones) and training history. They are not kept "on your phone only". Details: § 8.
- You buy the Subscription from Apple or from Google, not from us. Payment, the receipt, cancellation and refunds are handled by the store of purchase: the App Store or Google Play. We enable the entitlements once Apple or Google confirms the purchase. Details: § 11–§ 13.
- Not having a Subscription never locks your data. The Account moves to the Free Plan with its limits. Nothing is deleted and nothing is closed. Details: § 10.
Two regimes. Some provisions of these Terms apply only to Users who are businesses — where their use of the App is directly connected with their business or professional activity and is of a professional nature for them. Those provisions are marked expressly and do not apply to consumers or to the natural persons referred to in Article 3855 of the Polish Civil Code (a business enjoying consumer protection). Only statutory provisions apply in relation to a consumer; nothing in these Terms excludes or limits them.
§ 1. Definitions
- Provider, we — Movebuddy Software Spółka z Ograniczoną Odpowiedzialnością, with its registered office in Wrocław, ul. Marsz. Józefa Piłsudskiego 74 lok. 320, 50-020 Wrocław, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register, under KRS 0001258724, NIP 8971976759, REGON 545419926.
- App, MoveBuddy — the MoveBuddy application: mobile and browser-based, together with its server side and related network services.
- Service — making the App available for use on the terms of these Terms.
- User — a person who has created an Account in the App.
- Business — a User for whom use of the App is directly connected with their business or professional activity and is of a professional nature for them. Provisions marked as applying to Businesses do not apply to consumers or to the persons referred to in Article 3855 of the Civil Code.
- Account — an individual, password-protected set of a User's data and entitlements.
- Trainer — a User with the personal-trainer role, who works with their own Clients in the App and who is a party to the Subscription contract.
- Client — a User with the client role. A Client may be a Trainer's Client (in an open Collaboration with a Trainer) or a Self-guided User (with no Trainer assigned, using the App for themselves).
- Collaboration — the relationship between a Trainer and a Client recorded in the App, opened when an Invitation is accepted and closed when either party ends it.
- Invitation — a time-limited proposal to begin a Collaboration. An Invitation may come from a Trainer (an Offer) or from a Client who enters a Trainer's code (a Request).
- List Entry — a Client's position on a Trainer's client list, existing from the moment the Trainer adds them, including before an Offer is accepted.
- User Content — everything a User enters into or sends to the App: text, messages, photos, video files, voice recordings, measurements, questionnaire answers, plans, exercises and notes.
- Intake Questionnaire — the questionnaire the App asks a Client to complete before they start using the training part of the App.
- Check-in — a recurring review questionnaire (daily, weekly or monthly) in which the Client reports, among other things, body weight, sleep quality, energy levels, body measurements and, optionally, Progress Photos.
- Progress Photos — physique photos taken by the Client as part of a Check-in, in up to three views (front, side, back).
- Subscription — paid, renewable access to the App's extended limits.
- Free Plan — the free tier of the Service, with limits, on which every Account without an active Subscription runs.
- App Store — the application store operated by Apple Inc. and its group companies.
- Google Play — the application store operated by Google LLC and its group companies. The seller of Subscriptions bought on Google Play by users in the European Economic Area is Google Commerce Limited (Gordon House, Barrow Street, Dublin 4, Ireland).

§ 2. Who provides the Service
- The Service is provided by the Provider:

- The contact address for any matter concerning the Service, including complaints: contact@movebuddy.pl. The address for written correspondence is the registered address given in paragraph 1.
- The Terms are made available free of charge in the App and at https://movebuddy.pl/regulamin, in a manner allowing them to be obtained, reproduced and recorded.
- These Terms constitute the terms of service for the provision of services by electronic means within the meaning of the Polish Act on the Provision of Services by Electronic Means.
§ 3. What MoveBuddy is, and what it is not
This section sets the boundaries of the Service. It is the foundation of the whole document and takes precedence when the remaining provisions are interpreted.
- MoveBuddy is a tool. We supply software that lets you plan training sessions, record how they went, keep measurements, exchange messages and store the related files. What we provide is making that software available and keeping it running.
- We do not provide training services. We do not create training plans, we do not select exercises, loads or progressions, we do not run training sessions and we do not supervise how they are performed. Plans and exercises in the App are created by the Trainer or by the User themselves.
- We do not provide medical, physiotherapy or dietary services. We do not give health advice, we do not diagnose, we do not assess contraindications to exercise and we do not interpret health data entered into the App.
- The App is not a medical device within the meaning of Regulation (EU) 2017/745 and is not intended for the diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of disease. It does not replace consulting a doctor, a physiotherapist or a dietitian.
- The App does not screen anyone for fitness to exercise. We do not carry out screening or a PAR-Q-type qualification questionnaire and we do not collect declarations of the absence of contraindications. The health questions in the Intake Questionnaire exist solely so that the Trainer has the information the Client has chosen to share with them. We do not assess those answers and we draw no conclusions from them.
- We do not guarantee any training result. We do not promise gains in strength, weight loss, a change in physique, improved conditioning or any other outcome. The outcome depends on factors outside the Service.
- Calculations in the App are auxiliary. Progression figures, personal records, tonnage, plan adherence, percentage of maximum and similar values are an auxiliary tool based on data the User entered themselves. They are not a training recommendation or a health recommendation, and their correctness depends on the correctness of the input data.
- We are not a gym or a trainers’ association. The App is intended for independent personal trainers and their clients. We do not direct the Service at gyms or at organisations employing multiple trainers.
- The App has no social features. There is no sharing of content with other Users beyond one’s own Trainer, and there are no leaderboards or comparisons between Clients.
- The User decides for themselves whether to undertake physical activity and uses the training part of the App at their own risk. The User undertakes not to engage in activity for which a doctor has identified contraindications, to stop it if pain, dizziness, shortness of breath or other worrying symptoms occur, and to seek medical advice. We recommend consulting a doctor before starting or significantly changing physical activity, particularly in the case of illness, injury, pregnancy or medication being taken.
- The User provides health information in the App voluntarily and on their own initiative, in order to pass it to their Trainer. We do not collect it in order to assess fitness to exercise, we do not assess it, we do not interpret it and no function of the App relies on it.
- If damage arose or was increased as a result of providing untrue or incomplete information, of failing to comply with paragraph 10, with a doctor’s recommendations or with the Trainer’s instructions, that circumstance is taken into account when determining the scope of liability and the amount of compensation (Article 362 of the Civil Code).
§ 4. Technical requirements
- Using the App requires: a mobile device running the iOS or Android version stated as the minimum in the App Store or Google Play respectively, internet access, an active e-mail address and a current version of the App installed.
- The App requires an internet connection. Most functions do not work offline, and data entered without a connection may be synchronised with a delay or, in the event of a conflict, may not be saved.
- Selected functions require permission to access device resources: the camera and photo library (profile pictures, Progress Photos, photos and video in chat), the microphone (voice messages), notifications (push notifications). Refusing a permission disables that function but does not block the rest of the App.
- The User bears data transmission costs and device costs according to their operator’s price list.
- We recommend using a current version of the App and of the operating system. We do not guarantee the operation of a version of the App that is no longer supported, or operation on devices whose system protection has been compromised (jailbreak).
- App updates are distributed exclusively through the App Store and Google Play.
§ 5. Account, registration and minimum age
- Using the App requires an Account. An Account is personal and assigned to one person.
- An Account is created by registering with an e-mail address and a password, or by signing in with an Apple or Google account. While completing their profile, the User chooses a role: Trainer or Client. The administrative role is not available for self-selection.
- To create an Account we require: an e-mail address, first name, surname, gender and date of birth. A Trainer additionally provides a telephone number.
- The minimum age is 16. Age is verified on the server on the basis of the date of birth provided — registration by a person under 16 is rejected. Providing a false date of birth is a breach of these Terms and constitutes grounds for blocking the Account.
- The contract for the provision of the Service is concluded for an indefinite period when the Account is created. Creating an Account is free of charge. A condition of creating an Account is that the Terms and the Privacy Policy are made available to the User before the contract is concluded — in a manner allowing them to be obtained, reproduced and recorded — and that the User declares their acceptance.
- We record the fact of acceptance: the date and time the declaration was made, the version of the documents accepted, the Account identifier and technical data about the event. We keep that record for the duration of the contract and for the limitation period for claims arising from it.
- We deliver every change to these Terms to a User who has accepted them, in the manner set out in § 21. The version of the Terms binding on the parties is the one in force on the day the given act is performed and, as regards lasting effects, the version in force on the day those effects arose.
- A person registering on their own confirms their e-mail address. Until it is confirmed, the Account has limited functionality.
- The User provides true and current data. The User may not share their Account or login credentials with another person, or create an Account for another person without their knowledge — except for the Invitation described in § 7. The User is liable for acts performed using their login credentials, unless those acts resulted from circumstances for which we are responsible.
- The User protects their password. Please notify us immediately at contact@movebuddy.pl if the User suspects that someone has gained access to their Account.
§ 6. User roles
- The App has three roles: Trainer, Client and an administrative role reserved for the Provider (§ 8.4 point 6).
- A Trainer keeps a list of their Clients, creates training plans and exercises, assigns questionnaires, keeps a calendar and chat, and reviews their Clients’ training and measurement data. The Trainer is a party to the Subscription contract.
- A Trainer’s Client uses the App as part of the service provided by their Trainer. A Trainer’s Client does not pay us for using the App.
- A Self-guided User uses the App for themselves, without a Trainer — planning and performing their own training, keeping measurements and assigning questionnaires to themselves.
- A Trainer also trains themselves in the App. When a Trainer profile is created, a Client profile is created on the same Account, in which the Trainer runs their own training. This is not a second Account or a second login. That internal profile is permanent and cannot be deleted or detached — this has a direct consequence for deleting a Trainer’s Account, described in § 20 paragraph 3. That profile occupies one place in the Client limit.
§ 7. The Trainer–Client relationship and how it is formed
- A Collaboration arises only with the consent of both parties. The Trainer sends an Offer to a Client, or the Client sends a Request to a Trainer by entering their code. The Collaboration begins when the Invitation is accepted.
- A Trainer may add a person to their list by providing that person’s first name, surname and e-mail address — before that person has taken any action. A List Entry and a technical identity without a password are then created. From that moment the Trainer may prepare a plan for that person, assign questionnaires, schedule sessions, keep notes and record measurements. The invited person has no access to the client part of the App during that time — they cannot see the plan, the schedule, the chat or the Trainer’s profile. During that time the Trainer may write messages that the invited person will only see after accepting the Invitation.
- The invited person has the right to refuse. After the e-mail address is confirmed, we show who added them and ask for their consent. Refusing is just as easily available as accepting. Confirming an e-mail address is not in itself acceptance of a Collaboration.
- Two different time limits: the link and code from an Invitation are valid for 24 hours (they can be resent), while the Offer itself stands for 14 days.
- An Offer not accepted within 14 days, or withdrawn by the Trainer, disappears entirely. We then delete the technical identity, the List Entry and everything the Trainer attached to it — the plan, questionnaires, schedule, notes and measurements.
- Once the Invitation is accepted, the identity belongs to the Client. From that moment no action by the Trainer and no time limit deletes the Client’s Account. Ending a Collaboration archives the Client at the Trainer, but does not delete the person.
- If an Offer is sent to an e-mail address that already has an Account, we do not create a new identity and we do not ask for address confirmation. Consent is then given by the signed-in User.
- We are not a party to the contract between the Trainer and the Client. The contract for training services is concluded directly between the Trainer and the Client, outside the App. We are not responsible for its conclusion, performance, settlement or termination.
- We do not verify Trainers’ qualifications. We do not check Trainers’ education, certificates, licences, experience, insurance or criminal record. A Trainer’s presence in the App is not our recommendation or an attestation of their competence. The Client chooses a Trainer at their own risk.
- The author of a training plan is responsible for its content — the Trainer who created it, or the Self-guided User who created a plan for themselves. We do not approve plans, we do not assess their safety and we do not interfere with their content.
- Payments between a Client and a Trainer do not pass through the App. The App does not intermediate in payment for training services, does not accept such payments, does not settle them and does not issue documents for them.
- Either party may end the Collaboration at any time — both the Trainer and the Client. The Client does not need the Trainer’s consent to do so. The consequences are described in § 9.
- The Trainer is responsible for the legal basis for processing the data of a person they add. By adding a person to their Client list or sending an Invitation, the Trainer declares that they have a legal basis for processing that person’s personal data and that the person has expressed interest in collaborating or has otherwise authorised the Trainer to provide their e-mail address for that purpose.
- The information obligation towards an invited person is performed by the Trainer as regards the Trainer’s own processing (Article 14 GDPR). We perform it as regards our own processing — in the text of the Invitation and in the Privacy Policy.
- The Trainer must not include, in their own questionnaire questions or in other fields of the App, questions about the data referred to in Article 9(1) GDPR (in particular health, sexuality, beliefs or origin), unless they have their own valid basis under Article 9(2) GDPR. The Trainer must not make any health-related question mandatory. We may remove a question that breaches this paragraph or restrict the custom-questions function, informing the Trainer accordingly.
- Indemnity — applies only to Trainers who are Businesses. The Trainer shall indemnify us and make good any damage — including amounts awarded or settled, administrative fines and reasonable legal costs — that we incur in connection with the Trainer’s breach of paragraphs 13–15, with the content of a training plan or the quality of their services, or with a claim by their Client or by a person they invited. We shall notify the Trainer of a claim without undue delay and enable them to take part in the defence.
§ 7a. Roles in personal data protection
- In relation to a Client’s personal data, the Provider and the Trainer are separate, independent controllers. They are not joint controllers within the meaning of Article 26 GDPR, and the Provider is not a processor acting on the Trainer’s instructions within the meaning of Article 28 GDPR.
- The Provider is the controller as regards: maintaining the Client’s Account and providing the Service to them, making data available to the Trainer during an open Collaboration, the security of the App, handling Subscriptions and complaints, performing legal obligations, and maintaining and developing the App. The rules of that processing are described in the Privacy Policy.
- The Trainer is the controller as regards their own training service — in particular they decide what to ask in their own questionnaire questions, what data about the Client they enter, what notes they keep and how they use the results. In that scope the Trainer independently performs the controller’s obligations, including the information obligations under Articles 13 and 14 GDPR and the handling of data subject requests.
- We forward a Client’s request concerning data decided on by the Trainer to that Trainer and inform the Client that we have done so. We are not responsible for how the Trainer performs their obligations.
- Making a Client’s data available to the Trainer during an open Collaboration takes place on the basis of Article 6(1)(b) GDPR and, as regards health data, on the basis of the Client’s separate, explicit consent (Article 9(2)(a) GDPR).
- If a supervisory authority or a court finds that, in a particular scope, the Provider and the Trainer are joint controllers, Schedule 1 applies in that scope.
§ 8. The data and files we store — stated plainly
The rules for processing personal data, the legal bases and the User’s rights are described in the separate Privacy Policy; this section states plainly what we keep and where.
8.1. What you send to the App goes to our servers
Your data and files are not stored on your phone alone. We send them to our servers and store them there, because without that the Service cannot work: your Trainer has to see your data, your history has to be available after you change phones, and chat has to work on both sides.

We do not store your password in plain text — it is held as an irreversible hash by the authentication provider (paragraph 8.5).
The App asks for the Intake Questionnaire to be completed before you start using the training part. Check-ins never block access. A completed questionnaire is closed — its content can no longer be changed, and the questions are frozen at the moment of submission.
8.1a. Health data
Questions about past injuries, illnesses and health conditions and about medication taken concern special category data within the meaning of Article 9 GDPR. We ask them only after obtaining separate, explicit consent, which we request before the health section of the Intake Questionnaire. Answering these questions is voluntary, and refusing does not limit access to the App or to any of its functions. Consent may be withdrawn at any time in Account settings; withdrawal deletes those answers and removes the Trainer’s access to them. A Trainer may not make a health question mandatory (§ 7 paragraph 15).
8.2. Photos, video and voice recordings are not processed „locally”
- Progress Photos are resized and compressed on the device and then sent to our servers and stored there. Your Trainer can see them. Before the first upload we show separate information about where the photo goes and who will see it, and we ask for confirmation.
- Photos and video files sent in chat are stored on our servers and are visible to the other party to the conversation.
- Voice messages are recorded on the device and then sent to our servers and stored there. The other party to the conversation listens to them.
- We strip metadata from photos, including GPS coordinates — first on the device and then again on the server, before saving.
- You can delete any of your Progress Photos at any time. Deletion also takes effect for the Trainer.
8.3. Where the data and files physically sit
- We store files (photos, video, voice recordings) in cloud object storage. The private file store — holding Progress Photos and chat media — is assigned to infrastructure within the European Economic Area.
- Private files have no public addresses. They are served only through short-lived, signed links generated after permissions are checked.
- We do not keep a second copy of private files. Files live in one store only — we do not copy them to another provider or to our own infrastructure. Data loss at the storage provider would mean the loss of the files. We therefore recommend keeping your own copies of photos that matter to you (§ 17 paragraph 7).
- Profile pictures (avatars), exercise library material and exercise demonstration recordings uploaded by a Trainer are stored in public storage, at unguessable addresses. They are not indexed or linked to a list of Users, but they are not protected by a signed link. This also applies to a demonstration recording, which may show the Trainer’s image. Progress Photos never go into public storage.
- The database (Account, measurements, goals, training history, message content, questionnaires, subscription data) is operated for us by a cloud infrastructure and database provider, in a region within the European Economic Area.
- The application server (the compute part, holding no persistent User data) runs on a dedicated server within the European Economic Area.
8.4. Who sees your data
- Your Trainer sees their Client’s data: profile, Intake Questionnaire answers (including health-related ones), Check-in answers, body measurements and their history, Progress Photos, goals, full training history, calendar, statistics and the entire chat conversation.
- The Trainer’s note about a Client is visible only to that Trainer. The Client does not see it in the App. This does not affect the Client’s right to obtain its content under data protection law — please address such a request to contact@movebuddy.pl.
- The Trainer’s comments on a training session are visible to the Client and are read-only.
- Other Clients do not see your data. A Trainer who does not work with you will not even learn that your training session exists.
- We do not sell your data and we do not share it with third parties for marketing purposes.
- The Provider’s administrative role has technical access to Account data, including questionnaires, measurements and goals, to the extent necessary to maintain the Service and handle support requests. Administrative access does not include a Trainer’s notes about a Client.
- Access is held only by: you, your Trainer (while a Collaboration is open), our authorised employees and associates to the extent necessary, and our technical subprocessors listed in paragraph 8.5.
8.5. Who we entrust data to (technical subprocessors)
We use technical subprocessors. Below we identify the categories of recipients, what we use them for and what data reaches them.

We disclose the identity of specific processors at the request of the data subject — simply write to contact@movebuddy.pl.
We process data within the European Economic Area. Some transfers to third countries take place on the basis of standard contractual clauses approved by the European Commission; details are described in the Privacy Policy.
We do not write data content to technical logs. We do not log e-mail addresses, telephone numbers, first names, dates of birth, message content or notes, or health-related values — goals, measurements and training results.
We may entrust processing to further technical subprocessors and change existing ones. This requires neither the User’s consent nor a change to these Terms. We admit a new subprocessor only after concluding a data processing agreement meeting the requirements of Article 28 GDPR.
8.6. How long we store data
We store data for as long as the Account exists, but no longer than 24 months from the last activity on the Account (§ 20 paragraph 4a). After an Account is deleted we keep only the data listed in § 20 paragraph 8, for the periods stated there and solely for the purposes stated there.

- Pausing or deleting a Check-in preserves the answers already collected. The Intake Questionnaire cannot be deleted.
- After a Collaboration ends, the Client’s data remains on their Account. Only the Trainer’s access changes (§ 9).
8.7. Analytics and diagnostics
- We collect data about App crashes so that we can fix them. The report contains technical information and a pseudonymous Account identifier, without the content of your data.
- We collect telemetry about how the App and the server perform (response times, errors, the screen on which a problem occurred).
- The version of the App distributed through the App Store and Google Play does not record how screens are used — it carries no session recording or activity heatmaps. A tool of that kind may be enabled only in internal test builds and only after obtaining the explicit consent of the person using such a build; consent may be withdrawn at any time.
- We do not use User Content to train machine learning models made available to third parties. This does not preclude the use of anonymised data and aggregate compilations (paragraph 6) to develop our own solutions.
- We may analyse how the App is used — feature usage, event counters, response times, error rates — in order to maintain, measure and develop the Service and to plan new features. For those purposes we do not use the content of health data, Progress Photos, voice recordings or message content. The basis is our legitimate interest (Article 6(1)(f) GDPR); the User may object on the terms described in the Privacy Policy.
- On the basis of the data in paragraph 5 we create aggregate compilations and anonymised datasets from which no individual can be identified. Such compilations constitute our asset; we may use them without time limit, including after an Account is deleted, and may publish them as aggregate statistics.
8.8. Notifications and communication
- We send notifications about events in the App and messages necessary to perform the contract, ensure security and inform about changes to the Terms or material changes to the Service. We send marketing notifications and messages only with the User’s consent, given separately and withdrawable at any time in Account settings; the absence of consent does not affect access to the Service or the range of features.
- A Client may receive a notification about: a message from their Trainer, the Trainer’s review of a training session, a session scheduled for today, a Check-in to complete and — as a reminder from the device — an unfinished training session. A Trainer may receive a notification about a message from a Client and about a submitted Check-in.
- Each type of notification can be turned off separately, and the setting is saved with the Account, not on the device.
- We never put questionnaire answers, measurements or health data in the body of a notification. A chat message notification contains the sender’s first name and an excerpt of the message.
- The App has no notification history. We do not send notifications about a missed session, a backlog or a decline in form.
§ 9. Ending a Collaboration
- Either party may end a Collaboration at any time: the Trainer (for them it is called archiving a Client) or the Client (for them, ending the collaboration with the Trainer). The Client does not need the Trainer’s consent.
- Ending a Collaboration does not delete the Account or the data.
- After a Collaboration ends, the Trainer: keeps the archive entry (whom they worked with and over what period), past sessions in their calendar, their own notes and the record of their own work, their plan and exercise templates, and the chat history in read-only mode. They lose: the ability to write in chat, access to the Client’s current data, creating and assigning plans and questionnaires, and scheduling new sessions.
- After a Collaboration ends, the Client: keeps full access to the App as a Self-guided User, their entire history, records, measurements and statistics; may finish a plan already started; may read plans that were ever assigned to them; and keeps the chat history in read-only mode. Exercises created by the former Trainer remain visible in the Client’s plans and history but cease to be available in library search.
- Scheduled recurring sessions and Check-ins are stopped; future slots are released.
- Returning to a Collaboration with the same Trainer requires a new Invitation and consent, after 48 hours have passed since it ended and provided there is a place available within the Trainer’s limit.
- The Trainer ending a Collaboration is not separately notified. The Client recognises it by the change in the range of App features; their data and access to the App remain unaffected (paragraph 4).
- The Trainer’s internal Client profile (§ 6 paragraph 5) cannot be ended by either side.
§ 10. The Free Plan and its limits
- Every Account without an active Subscription runs on the Free Plan. The Free Plan is free of charge and is not time-limited.
- The Free Plan has limits — in particular a limit on the number of a Trainer’s active Clients. The number of Clients in the archive is not limited. Current limits are shown in the App. The Trainer’s internal Client profile (§ 6 paragraph 5) occupies one place in the limit, and the limit of every paid plan is raised by that one place.
- We may change the limits of the Free Plan and of paid plans for valid reasons, being: a material change in the cost of providing the Service, a change in the terms of providers on which the Service depends, the need to ensure the security or stability of the Service, a change in the law, or a material change in the range of App features. We give notice of a change of limits that is unfavourable to the User at least 30 days in advance, in the App and by e-mail. Such a change does not cause loss of access to data or the detachment of existing Clients; it may only restrict the ability to add new ones. A User who does not agree to the change may terminate the contract in the manner set out in § 21 paragraph 3. We introduce changes favourable to the User without notice. A change of limits does not affect the terms of a billing period already paid for.
- A List Entry occupies a place in the limit from the moment it is created — including before the invited person accepts the Offer.
- Not having a Subscription never means losing access to data. We do not delete, hide or close data because there is no Subscription.
- If, after a Subscription ends, the number of active Clients exceeds the Free Plan limit, existing Clients continue unchanged. Only inviting new Clients is blocked. We do not detach Clients automatically.
- Limits are verified on the server side. The App interface is only information about a limit, not its source.
§ 11. Subscription, and the fact that Apple or Google sells it
- The Subscription is purchased by the Trainer. A Trainer’s Client does not pay us for using the App. The ability for a Self-guided User to purchase a Subscription is planned; if and when it is made available, it will be covered by these same Terms.
- The Subscription is sold exclusively in the App, through the App Store or Google Play. The purchase takes place in the store’s payment sheet — Apple’s or Google’s — on the device.
- The seller vis-à-vis the buyer is Apple (for a purchase on the App Store) or Google
(for a purchase on Google Play). This means that:
- Apple or Google, not we, receives the payment;
- Apple or Google, not we, issues the buyer’s purchase confirmation and accounting document;
- Apple or Google, not we, handles the payment method, currency, taxes and conversions;
- Apple or Google, not we, considers and processes refunds (§ 13);
- cancelling a Subscription is done in the store of purchase — in App Store settings or in Google Play, in the Subscriptions section — not in the App (§ 12).
- From Apple or Google, through the provider referred to in § 8.5, we receive purchase confirmation and Subscription status, and on that basis we enable the entitlements on the Account. We have no access to your card details or to your payment method.
- Prices are set and displayed by the App Store or Google Play in your currency, including applicable taxes. Prices may change; Apple or Google gives notice of a price change for a running Subscription on its own terms, and a change requiring your consent does not take effect without that consent.
- The Subscription renews automatically for a further billing period (monthly or annual, according to the product chosen), unless it is cancelled at least 24 hours before the end of the current period. Apple or Google charges the fee within 24 hours before the start of the new period.
- If a trial period is offered, its length and conditions are stated at the point of purchase. Eligibility for a trial period is verified by Apple or Google, not by us. Any unused part of a trial period lapses when a Subscription is purchased.
- Changing plan: an upgrade takes effect immediately, with pro-rata settlement on Apple’s or Google’s side. A downgrade and a change of billing period take effect at the start of the next billing period.
- Failed payment: if Apple or Google cannot collect the fee, the Subscription may enter a grace period or a hold period. Once those periods pass without success, the Subscription expires and the Account moves to the Free Plan — with no loss of data.
- Restoring purchases: a Subscription bought through an Apple or Google account can be restored on an Account in the App. One store Subscription can be assigned to only one Account in the App at any given time. Restoring it on another Account moves it there, and the previous Account moves to the Free Plan. Before that happens we ask for confirmation, and the Account losing the Subscription is notified by e-mail.
- If an active Subscription exists simultaneously on two store channels, the App warns about the double charge. Cancelling the unnecessary Subscription is done on the side of the relevant store.
- The accounting document is issued by the seller, that is Apple or Google, on its own terms and through its own tools. We do not issue invoices for the Subscription and have no technical means of issuing them.
§ 12. Cancelling a Subscription
- You cancel a Subscription bought on the App Store in App Store settings on your device, in the subscriptions section of your Apple account, and a Subscription bought on Google Play — in the Google Play app, in the Subscriptions section. The App provides a shortcut that opens the relevant screen, but the cancellation itself takes place on Apple’s or Google’s side.
- Cancelling turns off automatic renewal. You keep access until the end of the billing period already paid for. After it ends, the Account moves to the Free Plan.
- Cancelling a Subscription does not delete the Account or the data (§ 20) and is not in itself a request for a refund (§ 13).
- We cannot cancel a Subscription for you — we have no technical means of doing so on the App Store side or on the Google Play side.
§ 13. Refunds and the right of withdrawal
- Refunds are processed by the seller — Apple or Google. A refund request for a Subscription bought on the App Store is submitted to Apple (for example through reportaproblem.apple.com or Apple account settings), and for a Subscription bought on Google Play — to Google, in accordance with the Google Play refund policy. The seller decides according to its own rules. We have no ability to grant or process a refund on Apple’s or Google’s behalf.
- If Apple or Google refunds the fee, the entitlements on the Account will be turned off or reduced accordingly, without undue delay after we receive notice of the refund. The Account then moves to the Free Plan — with no loss of data.
- Right of withdrawal (consumers). A consumer concluding a distance contract has a statutory right of withdrawal within 14 days. In the case of a Subscription this concerns the contract concluded with Apple or Google as the seller, and therefore withdrawal and refund are handled in the manner set out in paragraph 1, under the rules of Apple or Google respectively and the law applicable to that contract.
- Right of withdrawal from the contract with us. The contract for maintaining an Account (§ 5 paragraph 5) is concluded with us and is free of charge. A consumer may withdraw from it within 14 days of its conclusion without giving a reason, by sending a declaration to contact@movebuddy.pl. They may also delete the Account at any time (§ 20) — a simpler route to the same result, and one not subject to a time limit.
- Beginning to use the Service at the consumer’s express request before the withdrawal period expires does not deprive them of the right of withdrawal but — as regards paid performance — may entail an obligation to pay for the performance rendered up to the moment of withdrawal, under the rules of the Polish Act on Consumer Rights.
§ 14. Subscriptions we grant free of charge
- We may grant an Account the entitlements of a paid plan free of charge — for example in a test programme, as part of a partnership, or as compensation in complaint proceedings. Such an entitlement does not come from the App Store or Google Play and is not a purchase.
- A free entitlement has a set end date and expires when that date passes, without renewal. After expiry the Account moves to the Free Plan — with no loss of data.
- A free entitlement is granted at our discretion, is non-transferable, has no monetary value and cannot be exchanged for money.
- We may revoke a free entitlement before its end date. We give 7 days’ notice of revocation and, in the event of a breach of these Terms or where the basis for granting it ceases to exist, with immediate effect.
- Holding a free entitlement alongside a store Subscription is not a double charge and does not give rise to a right to a refund.
§ 15. User Content and the licence we need
- User Content belongs to the User. We do not acquire copyright in your photos, recordings, plans, exercises, notes or messages.
- In order to provide the Service we need a licence. By sending User Content to the App, you grant us a non-exclusive, royalty-free, territorially unlimited licence, limited to the scope necessary to provide the Service, in the following fields of exploitation: fixation and reproduction by any technique, including digital; entry into the memory of computers and servers; storage and reproduction for the purposes of backups and of ensuring continuity and security of operation; technical processing (format conversion, compression, resolution change, generating a thumbnail or preview frame, stripping metadata); transmission over telecommunications networks; making publicly available in such a way that the persons identified in § 8.4 can access it at a place and time of their choosing.
- The licence includes the right to grant further licences (sublicences) to our technical subprocessors listed in § 8.5, solely to the extent necessary to provide the Service, and permission to exercise and to authorise the exercise of derivative rights in adaptations created solely as a result of the technical operations listed in paragraph 2.
- The User undertakes not to exercise their moral rights against us as regards the right to the integrity of the content and form of the work and to attribution of authorship — to the extent necessary for the operations in paragraphs 2 and 3. Those rights remain inalienable.
- The licence is granted solely for the purpose of providing the Service. It does not cover the use of your Content in marketing materials, publication, or disclosure to anyone beyond the scope set out in § 8.4.
- The licence expires when the Content or the Account is deleted, except that it remains in force:
- for the time necessary to complete the deletion (§ 20 paragraph 6);
- as regards Content necessary to establish, pursue or defend claims — until the limitation period for those claims expires;
- as regards anonymised data and aggregate compilations — without time limit, it being understood that such data does not allow the User to be identified.
- The User declares that they hold the rights to the Content they send and that sending it does not infringe the rights of third parties. In particular, the User does not send photos, recordings or images of other persons without their consent.
- Material created by a Trainer — plan templates, exercises, questionnaire templates — remains the Trainer’s material. The Trainer keeps it after a Collaboration ends and after a Client deletes their Account, provided it does not identify that Client.
- We may remove or block Content that infringes the law or § 16, after obtaining reliable notice of its unlawful character, in the manner set out in § 16a.
- Feedback. Comments, suggestions, proposed improvements, bug reports and ideas concerning the App, passed to us by a User in any form, are provided voluntarily and free of charge. We may use them without restriction — in particular implement, develop, modify, combine them with our own solutions and use them commercially — without any obligation to pay remuneration, to attribute authorship, to maintain confidentiality or to inform how they were used.
- If Feedback constitutes a work, the User grants us a non-exclusive, royalty-free licence unlimited in time and territory, with the right to grant sublicences, in the following fields of exploitation: fixation and reproduction by any technique; entry into computer memory; placing on the market; making publicly available in such a way that anyone may access it at a place and time of their choosing; and authorises the exercise of, and authorisation to exercise, derivative rights. Paragraphs 10–11 do not apply to User Content.
§ 15a. Our rights and the licence granted to the User
- The App — its source and object code, interface, structure, visual design, documentation, the MoveBuddy name and logo, the exercise library material and the databases — is the subject of our exclusive rights or those of our licensors. The App’s databases are protected under the Polish Act on the Protection of Databases.
- Upon creation of an Account we grant the User a non-exclusive, non-transferable, revocable licence to use the App on a device they own or use, solely for their own use and solely for the purpose of using the Service in accordance with these Terms, for the duration of the contract. The licence does not include the right to grant sublicences, or to rent, lease, lend, resell or make the App available to third parties.
- These Terms do not transfer any intellectual property rights to the User. All rights not expressly granted remain with us.
- The User does not remove or alter copyright notices, trade marks or other identifying markings placed in the App.
- The User does not use our name, trade marks or logos without our prior consent given at least in documentary form, except for truthful information about using the App.
- The prohibition in § 16 point 10 is without prejudice to the rights vested in the User under Article 75(2) and (3) of the Polish Act on Copyright and Related Rights.
§ 16. Prohibited use of the App
The following are prohibited:
- using the App in a manner contrary to the law, these Terms or good practice;
- sending content that is unlawful, offensive, hateful, inciting violence or pornographic, and content depicting minors in a sexual context;
- sending photos, recordings or the image of another person without their consent, in particular physique photos of another person;
- harassing, intimidating or persistently contacting another person through chat;
- sharing an Account or login credentials with another person, and creating an Account using another person’s details;
- use of the App by a person under 16 years of age;
- adding to a Client list persons about whom the Trainer does not know whether they wish to collaborate, and in particular providing the e-mail addresses of persons who have not expressed interest in collaborating;
- circumventing Free Plan limits, Subscription mechanisms, purchase verification or entitlements, including by creating multiple Accounts in order to circumvent the Client limit;
- automated data collection (scraping), bulk queries, load testing and attempts to gain unauthorised access to the App, to other people’s accounts or to our infrastructure;
- decompiling, disassembling and reverse engineering the App beyond what is permitted by mandatory provisions of law;
- introducing malicious software into the App;
- reselling, renting out or making the Service available to third parties as one’s own service, and the use of a single Trainer Account by multiple trainers;
- using Client data obtained in the App for purposes other than providing training services to them;
- impersonating another person or an employee of the Provider, and disseminating untrue information about the Service;
- using the App to give medical advice, to diagnose or to treat;
- using the App, its features, data or documentation to create, develop or improve a competing product or service, and giving access to the App to an entity carrying on activity competing with the Provider;
- carrying out benchmarking, performance testing and competitive analysis of the App and publishing the results without our prior consent given at least in documentary form;
- using the App by means of automated tools or interfaces other than those we provide, or integrating the App with other systems without our consent;
- taking action aimed at circumventing security measures, access restrictions, entitlement verification or limit control mechanisms, and assisting others in doing so.
A breach of this section entitles us to take the actions described in § 18 paragraph 5 and to pursue contractual penalties (§ 16b) and compensation on general principles.
§ 16a. Reporting unlawful content and moderation decisions
- Any person or entity may report content they consider unlawful to us by sending a notice to contact@movebuddy.pl. The notice should contain: a sufficiently substantiated explanation of the reasons why the content is unlawful; a clear indication enabling it to be located (Account or message identifier, date and time); the name or business name and the e-mail address of the person submitting it — except for notices concerning the offences referred to in Articles 3–7 of Directive 2011/93/EU; and a statement confirming the good-faith belief that the information in the notice is accurate and complete.
- We confirm receipt of a notice and consider it in a timely, non-arbitrary and objective manner and with due diligence. We inform the person who submitted it of our decision and, where we take action in relation to content or an Account, we also inform the User concerned, in the manner set out in § 18 paragraph 5.
- A notice containing the elements listed in paragraph 1 gives us reliable notice of the unlawful character of the content, provided it allows that unlawfulness to be established without a detailed legal analysis.
- The point of contact for users and for the authorities of Member States, the European Commission and the European Board for Digital Services, within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065, is contact@movebuddy.pl. The language of communication is Polish and, in contacts with authorities, also English.
- We do not carry out prior moderation or general monitoring of the content exchanged between a Trainer and a Client, and we are under no obligation to seek it out (Article 8 of Regulation (EU) 2022/2065). We take decisions on the basis of notices, orders from authorities or knowledge otherwise obtained.
- Paragraphs 1–3 apply to notices concerning infringements of copyright, personal rights and image.
§ 16b. Contractual penalties
This section applies only to Users who are Businesses. It does not apply to consumers or to the persons referred to in Article 3855 of the Civil Code.
- A User who is a Business and who breaches § 16 points 8, 9, 12, 13 or 16–19 shall pay us a contractual penalty of PLN 5,000 for each breach and, in the case of a continuing breach, for each commenced month of its duration.
- Payment of a contractual penalty does not preclude pursuing compensation exceeding its amount on general principles.
- The contractual penalty is payable within 14 days of the date on which the demand is delivered.
§ 17. Availability, interruptions and changes to the App
- We make every effort to keep the App running without interruption, but we do not undertake to meet any particular level of availability (SLA) unless separately agreed in writing.
- We may carry out planned maintenance interruptions. If we anticipate that an interruption will last longer than 24 hours, we will give advance notice in the App or by e-mail.
- Unplanned interruptions are possible — failures, security incidents, failures at the providers listed in § 8.5, force majeure. We remedy them without undue delay after detection.
- The Service depends on external providers (the App Store, Google Play, the authentication and database provider, file storage, push notification operators). The consequences of their failures are assessed under § 17a and § 18.
- The App is under development — we add, change and withdraw features. We may introduce changes that improve the Service, enhance security or result from legal obligations without notice, provided they do not materially limit the scope of the Service.
- If we intend to materially limit or withdraw a feature you use, we will give at least 30 days’ notice in the App or by e-mail. We do not guarantee that any particular feature will remain available indefinitely.
- We recommend that the User does not treat the App as the only place where data that is irreplaceable to them is stored — in particular that they keep their own copies of important photos.
§ 17a. Force majeure
- We are not liable for non-performance or improper performance of the Service to the extent that it results from force majeure. Time limits for our obligations are suspended for the duration of the force majeure event and its direct effects.
- Force majeure means an external event, impossible to foresee and whose effects could not have been prevented with due diligence, in particular: a natural disaster, fire, flood, war, a terrorist attack or a widespread cyberattack, an act of public authority, sanctions, a general failure of the power or telecommunications network, a general strike, an epidemic, and also an extensive failure or cessation of services by a provider of infrastructure on which the Service depends, if that event itself meets the conditions of the first sentence and we had no realistic possibility of replacing that provider within a reasonable time.
- We give notice of a force majeure event without undue delay in the App or by e-mail and take steps to limit its effects.
- If a state of force majeure continues uninterrupted for more than 60 days, either party may terminate the contract with immediate effect, without compensation.
§ 18. Liability
- We are liable for non-performance or improper performance of the Service on general principles, to the extent provided by law. Nothing in this section excludes or limits liability that cannot be excluded or limited under mandatory provisions of law — in particular liability for damage caused intentionally, for personal injury, and liability towards a consumer as regards conformity of the performance with the contract.
- We are not liable for:
- the content and effects of a training plan or the manner in which it is performed — the author of the plan (the Trainer or the User themselves) and the person training are responsible for those;
- the acts and omissions of a Trainer, the quality of their services, their qualifications, their settlements with a Client and the performance of the contract between the Trainer and the Client;
- the correctness of data entered by the User and of the results of calculations based on that data;
- content sent between Users;
- the operation of the User’s device, their operating system, network or third-party software.
- We do not guarantee any training result (§ 3 paragraph 6). The absence of an expected result is not improper performance of the Service.
- Limitation of liability towards Businesses.
This paragraph applies only to Users who are Businesses — including Trainers. It does not apply to consumers or to the persons referred to in Article 3855 of the Civil Code.
- we are liable solely for damage caused intentionally or through gross negligence; liability for damage caused by unintentional fault not amounting to gross negligence is excluded;
- we are liable solely for actual damage; we exclude liability for lost profits, loss of revenue, loss of customers or contracts, loss of goodwill, loss, corruption or unavailability of data and the costs of restoring it, business interruption, and for indirect and consequential damage;
- we exclude liability for third-party claims directed at the User, including claims by a Trainer’s Clients relating to the training service, the content of a plan, the quality of care or settlements;
- our aggregate liability for all events occurring in any period of 12 consecutive months is limited to the total Subscription fees paid by that User in the 12 months preceding the event; where the User has paid no fees — in particular where they used the Free Plan or an entitlement granted free of charge — liability is limited to PLN 500;
- the User reports damage to us without undue delay after discovering it, and no later than within 30 days, to the address given in § 2 paragraph 2, stating the date, time and circumstances of the event. A report made after that period does not extinguish the claim, but the User acknowledges that technical event records are kept for a limited time (§ 23 paragraph 10);
- The limitations and exclusions in this paragraph do not apply to damage caused intentionally — a stipulation that a debtor will not be liable for damage caused intentionally to the creditor is invalid (Article 473 § 2 of the Civil Code). Nor do they apply to liability that cannot be excluded or limited under mandatory provisions of law.
- Blocking and termination for breach. In the event of a breach of § 16 we may — proportionately to the breach — demand that it cease, remove the content in question, restrict Account features, suspend the Account or terminate the contract. Before suspension or termination we call for the breach to cease and set a deadline of no less than 7 days, unless the breach is gross, recurring, constitutes a prohibited act or threatens the security of the Service or of other Users — in which case we may act immediately. In relation to a User who is a Business, we may suspend the Account or terminate the contract with immediate effect, without a prior demand and without setting a deadline. We inform the User of every decision to remove content, restrict features, suspend an Account or terminate the contract, stating the scope and type of restriction, its factual basis and its basis in these Terms, information about any use of automated tools, and instructions on the appeal procedure (§ 19) and on the possibility of pursuing rights before a court.
- Suspension of an Account does not delete the User’s data. Once the reason for suspension ceases, we restore access to the Account. Suspension does not give rise to a right to a refund of fees or to compensation, unless it proved to be unfounded.
- A breach of these Terms by a Trainer does not affect their Clients’ Accounts, and a breach by a Client does not affect their Trainer’s Account.
§ 18a. Scope of performance, statutory and commercial warranty
- The Service is made available in the condition and with the functional scope in which it is available at the given time. We do not warrant that the App will be free of errors, that it will operate without interruption, or that it will meet the User’s individual expectations as to fitness for a particular purpose.
- Our performance does not include: archiving data at the User’s request, maintaining backups on their behalf, restoring data lost for reasons attributable to the User, their device or external providers, or ensuring the App’s compatibility with third-party software and devices.
- In relation to Users who are Businesses, we exclude the statutory warranty for defects (rękojmia) and all warranties, express and implied, to the fullest extent permitted by law.
- Paragraph 3 does not apply to consumers or to the persons referred to in Article 3855 of the Civil Code. In relation to a consumer, the provisions on conformity of digital content or a digital service with the contract apply, and these Terms neither exclude nor limit them.
§ 19. Complaints
- A complaint may be submitted in any matter concerning the Service, to contact@movebuddy.pl or in writing to the address given in § 2 paragraph 2.
- A complaint should contain: information identifying the Account (e-mail address), a description of the problem, the date it occurred and the outcome expected. The absence of any of these elements is not an obstacle to considering the complaint.
- We consider a consumer’s complaint within 14 days of receiving it and reply within that period. Failure to reply to a consumer’s complaint within 14 days means the complaint is upheld.
- We consider a complaint from a User who is neither a consumer nor a person referred to in Article 3855 of the Civil Code within 30 days. The consequence set out in the last sentence of paragraph 3 does not apply to such Users.
- Complaints concerning payments, refunds and cancelling a Subscription should be addressed to Apple or Google (§ 12–§ 13). Where a complaint concerns entitlements on the Account after a purchase, we consider it.
- Out-of-court dispute resolution (consumers). A consumer may use out-of-court means of handling complaints and pursuing claims, in particular: mediation at the voivodeship inspectorate of the Trade Inspection, a permanent consumer court, the assistance of the district (municipal) consumer ombudsman or of a social organisation acting for consumers. Use of these procedures is voluntary and does not deprive anyone of the right to go to court.

§ 20. Termination and Account deletion
- A Client and a Self-guided User may terminate the contract at any time, without giving a reason and without a notice period, by deleting their Account in the App.
- Deleting a Client’s Account requires the Collaboration to be ended first. The Client may end it themselves, without the Trainer’s consent (§ 9 paragraph 1).
- A Trainer’s Account. Because the Trainer’s internal Client profile (§ 6 paragraph 5) is permanent and cannot be ended, a Trainer deletes their Account by submitting a request to contact@movebuddy.pl; we carry it out without undue delay and no later than within 30 days of receiving the request. The effects and scope of deletion are the same as in paragraphs 5–8.
- We may terminate the contract on 30 days’ notice for valid reasons, being: ceasing to provide the Service or a material part of it; a material change in the model of provision or of charging for the Service; permanent loss of the technical, legal or economic ability to provide the Service on the existing terms, including as a result of a change of terms or the end of cooperation by a provider on which the Service depends; a change in the law or in App Store or Google Play requirements making it impossible to continue providing the Service in its existing form; and use of the Service in a manner causing a persistently disproportionate load on our infrastructure. We give notice of termination by e-mail, stating the reason. During the notice period the Account remains available and the User may save their data themselves. If termination occurs during a billing period already paid for, we maintain the paid plan entitlements until the end of that period. Termination of the contract for breach of these Terms takes place in the manner set out in § 18 paragraph 5.
- Inactive Account. We may delete an Account, together with its data, where no sign-in and no activity has occurred for 24 consecutive months. Before deletion we send two notices to the e-mail address assigned to the Account — the first 30 days and the second 7 days before the planned deletion. Signing in before the deadline interrupts the running of that period. The effects of deletion are set out in paragraphs 6–9.
- Deleting an Account removes access immediately. From the moment the request is confirmed you lose the ability to sign in, and the Account ceases to be visible in the App to anyone, including your former Trainer.
- Physically erasing the data is a process, not a moment. After access is removed we delete the data in the background: first the database records, then the files in file storage, then the identity at the authentication provider. The process is retried until it completes. From the moment the request is confirmed, no one has access to that data any more.
- What we delete: all training sessions, sets and performances; assigned plans; assigned questionnaires together with the answers; goals; body measurements; Progress Photos; the Trainer’s notes about you; calendar events and recurring series; the entire chat conversation, including the Trainer’s messages; the Collaboration records together with the entry in the Trainer’s archive. The Trainer keeps only material they created themselves and which does not identify you.
- What remains, and why:
- a pseudonymous record of the deletion itself — an identifier containing no personal data, the date of the request and the date it completed;
- data necessary to establish, pursue or defend claims — first name, surname, e-mail address, the dates the contract was concluded and terminated, the version of the Terms accepted, the history of complaints and correspondence with us and, where a claim is raised or reasonable grounds arise to anticipate one, also the data necessary to defend against that specific claim, including Intake Questionnaire answers and the chat record. We keep this data with restricted access, separated from data used operationally, solely for that purpose and solely for the limitation period for claims (Article 17(3)(e) GDPR and, as regards health data, Article 9(2)(f) GDPR);
- Subscription and billing event records, after they are detached from your identity; retention period: 5 years from the end of the tax year in which the tax payment deadline fell;
- accounting and tax documentation, to the extent and for the period resulting from accounting and tax law;
- pseudonymous identifiers in technical logs, until the end of the log retention period;
- a pseudonymous record at the provider handling Subscriptions (§ 8.5), deleted in accordance with that provider’s terms.
- Deleting an Account does not cancel the Subscription in the App Store or Google Play. The Subscription must be cancelled separately (§ 12), otherwise Apple or Google will keep renewing it.
- Deleting an Account is irreversible. We do not restore deleted data, even on express request. We recommend saving important data yourself before deleting your Account — the App currently has no export function, so a copy has to be made manually.
§ 21. Changes to these Terms
- We may change these Terms where the scope or manner of providing the Service changes, where the law or the requirements of providers on which the Service depends change (in particular Apple or Google), where the charging model changes, or where a change is necessary for the security of the Service or to remove ambiguity.
- We give notice of a change at least 30 days before it takes effect — in the App and by e-mail to the address assigned to the Account. In that notice we state what is changing and give the date the change takes effect.
- If you do not agree to a change, you may terminate the contract before the day it takes effect — by deleting your Account or by a declaration sent to contact@movebuddy.pl. Termination in this manner is free of charge. The absence of objection by the day the change takes effect, together with continued use of the App, means the amended Terms are accepted.
- A change to these Terms does not change the Subscription conditions of a billing period already paid for.
- Purely housekeeping changes (correcting an obvious mistake, updating contact details, clarifications that do not change the scope of rights and obligations) take effect upon publication; we give notice of them in the App.
§ 22. Apple as beneficiary and App Store terms
- These Terms are an agreement between the User and the Provider, not with Apple. Apple is not a party to that agreement.
- Apple is not responsible for the App or its content. The User addresses any claims concerning the App — including for non-conformity with the contract, product liability, infringement of third-party rights or of consumer protection law — to the Provider and not to Apple, without prejudice to rights arising against Apple under the contract of sale concluded with Apple (§ 11–§ 13) or under mandatory provisions of law.
- Apple is under no obligation to provide support or maintenance in respect of the App.
- If the App does not conform to a warranty applicable in the relevant store, the User may notify Apple and Apple may refund the purchase price; beyond that, Apple has no warranty obligations whatsoever in respect of the App.
- Apple and its group companies are beneficiaries of these Terms as regards the provisions of this section and are entitled to enforce them against the User.
- The User represents that they are not located in a country subject to an embargo and that they are not listed on any list of sanctioned parties, to the extent required by the App Store terms.
- Use of the App downloaded from the App Store is additionally subject to the App Store terms of use, and use of the App downloaded from Google Play — additionally to the Google Play terms of use.
§ 23. Governing law, courts and final provisions
- The law governing these Terms and the contract for the provision of the Service is Polish law.
- The choice of Polish law does not deprive a consumer of the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with consumers are heard by the court having jurisdiction under the Polish Code of Civil Procedure. We do not restrict a consumer’s right to a court and we do not impose the court having jurisdiction over our registered office.
- Disputes with Users who are Businesses are heard by the court having local jurisdiction over the Provider’s registered office. That court has exclusive jurisdiction also in matters involving Users established outside the Republic of Poland.
- If any provision of these Terms proves to be invalid or ineffective, the remaining provisions remain in force. An invalid provision is replaced by the relevant provision of law.
- Provisions of these Terms that are less favourable to a consumer than mandatory provisions of law do not bind the consumer; those provisions of law apply in their place.
- We may transfer the rights and obligations arising from the contract to another
entity, in particular in the event of a merger, division or transformation, a disposal of the
business or of an organised part of it, or a change of the entity providing the Service within the
group. A transfer may not worsen the terms on which the Service is provided or the scope of the
User’s rights. We give at least 30 days’ notice of an intended transfer, identifying the
acquiring entity and the date of transfer; during that time the User may terminate the contract in
the manner set out in § 21 paragraph 3. We may transfer receivables owed to us
by the User without restriction.
The User may not transfer the rights or obligations arising from the contract, in particular may not dispose of, rent out or share the Account, without our prior consent given at least in documentary form. The Account is non-transferable. A User who is a Business may not set off their receivable against ours or withhold payment of amounts due to us without our consent.
- The rules for processing personal data are described in the Privacy Policy, available in the App and at https://movebuddy.pl/polityka-prywatnosci. In the event of any discrepancy between these Terms and the Privacy Policy in matters of personal data protection, the Privacy Policy prevails.
- These Terms were drawn up in Polish. Where a version in another language is produced — including this English version — the Polish version prevails, and the English text is provided for information only and has no independent legal effect. All correspondence and proceedings are conducted in Polish.
- Circumstances relating to use of the Service — in particular the date and content of declarations made in the App, the date these Terms were accepted and the version accepted, the fact and time of acts performed in the App, the scope of features made available and the course of communication with us — are evidenced by the records of our IT systems. Those records constitute a document within the meaning of Article 773 of the Civil Code and may be produced as evidence. This provision does not restrict the User’s right to produce evidence to the contrary and does not exclude any means of evidence. Technical event records are kept for the retention period of the monitoring tool, as stated in the Privacy Policy.
- We address declarations and notices to the User at the e-mail address assigned to the Account and, additionally, in the App. A message sent to that address is deemed delivered at the moment when the User was able to acquaint themselves with its content (Article 61 § 2 of the Civil Code). The User keeps the e-mail address assigned to the Account current and in working order; the consequences of failing to do so are borne by the User. The User’s declarations addressed to us are submitted to the address given in § 2 paragraph 2.

Schedule 1. Joint controllership arrangement
The following arrangements apply only to the extent that a supervisory authority or a court finds that the Provider and the Trainer are joint controllers of a Client’s data (§ 7a paragraph 6). This is the essence of the arrangement within the meaning of Article 26(2) GDPR.
- Division of information obligations: the Provider informs the individual about processing connected with maintaining the Account and operating the App (the Privacy Policy); the Trainer informs about processing connected with their own training service, including their own questions and notes.
- Exercise of individuals’ rights: an individual may exercise their rights against either joint controller. Requests concerning Account data and the operation of the App are handled by the Provider; requests concerning data entered by the Trainer are handled by the Trainer. The recipient of a request forwards it without undue delay to the appropriate joint controller and informs the individual accordingly. The time limit for a reply is one month from receipt of the request by the first of them.
- Security: the Provider is responsible for the technical and organisational measures relating to the App and the infrastructure (Article 32 GDPR); the Trainer is responsible for the security of access to their own Account and devices and for the scope of the data they enter.
- Personal data breaches: a breach concerning the App and the infrastructure is notified to the authority by the Provider; a breach on the Trainer’s side, by the Trainer. The parties inform each other of a breach without undue delay and no later than within 24 hours of establishing it.
- Point of contact for data subjects: contact@movebuddy.pl, without prejudice to the right to contact the Trainer directly.
- Settlements between joint controllers: a joint controller who has made good damage or paid an administrative fine in the part corresponding to the other’s responsibility may claim back that part from them (Article 82(5) GDPR).
